대법원은 올해 중반에 대법원의 업무경감을 이유로 대법원 이외에 경미한 사건의 상고심을 처리하기 위해 상고법원을 별도로 두는 ‘법원조직법 일부개정법률안’ 등 상고법원제 법안을 국회에 제출했다. 이 상고법원제 법안에 따르면 상고법원제는 대법원이 상고심에서 재판할 사건들을 선별적으로 고르고 나머지 대부분의 상고심 사건들을 상고법원으로 보내 최종심인 상고심 재판을 받게 하자는 것이다. 그러나 결론부터 이야기해서 이러한 상고법원제 법안은 여러 위헌적 요소들을 가지고 있으며, 헌법외적으로도 많은 문제점들을 지니고 있다. 본 논문에서는 우리나라에서 과거 상고심 개혁을 위한 어떤 시도들이 있었는지, 국회에 제출된 상고법원제 법안들의 주요 내용들은 무엇인지, 상고심과 관련한 주요 외국들의 사례는 어떠한지, 상고법원제 법안의 헌법적 문제점들은 무엇인지, 상고법원제 법안의 헌법외적인 기타 문제점들은 무엇인지를 살펴보고 그 대안으로 대법관 증원안을 제시한다.
Abstract
Korean Supreme Court submitted the bill on the Third Instance Court by way of a Congressman this year. The purport of this bill is to have a separate third instance court in order to reduce the heavily increased caseloads of Korean Supreme Court. According to the bill, Korean Supreme Court selects few cases which it would handle and send the other cases to the separate Third Instance Court. However, conclusively speaking, I think the bill has many unconstitutional factors and many problems as a judicial policy. This paper will examine the previous attempts to reform the third instance trials in the past, what are the main issues of the bill on the Third Instance Court that was submitted to the Congress, what are the rules regulating the third instance cases in the advanced foreign countries, what are the unconstitutional factors of the bill, and what are the problems of the bill as a judicial policy. Finally this paper will present on what can be the desirable alternative of the bill.
