동 논문은 2021년 7월 EU집행위원회가 채택 발표한 EU 탄소국경조정제(EU CBAM) 규정안을 분석하여 EU CBAM이 GATT/WTO과 충돌되는지 여부를 검토하고 있다. GATT/WTO체제는 자유롭고 공정한 무역을 위하여 최혜국대우, 내국민대우 및 수량제한금지 원칙 등 기본원칙을 근간으로 작동하고 있다. EU CBAM은 탄소누출로 인한 불공정한 무역과 전 지구적 온실가스 감축을 목적으로 도입하였다. 또한 GATT 제20조는 기본원칙에 대한 일반예외로서 인간, 동식물 생명이나 건강을 보호하기 위해 필요한 조치 또는 유한 천연자원의 보존에 관련된 조치를 허용하고 있다. 이에 동 논문은 EU CBAM이 해당 예외에 해당하는 지를 검토한다. 이를 위해 동 논문은 분석 방법으로서 EU CBAM이 국경조정세, 조세 또는 공과금 등 재정적 조치인지 또는 EU가 주장하는 바와 같이 재정조치가 아닌 환경조치인지 그 법적 성격을 EU CBAM 규정안에서 제시한 방식을 통해 검토하고 이에 따라 EU CBAM이 GATT/WTO에 따라 허용될 수 있는지를 검토한다. 마지막으로 현재 EU CBAM 적용 대상 상품인 철강 및 알루미늄의 경우 우리나라가 EU에 수출하는 주요 품목이라는 점에서 국제통상 차원의 국내 정책적 시사점 역시 제공한다.
Abstract
This article explores EU CBAM regulation which was adopted by EU Commission in July of 2021 in order to examine its conformity to GATT/WTO rules. For free and fair trade, GATT/WTO system has run basic principles such as MFN, national treatment and prohibition of quantity restriction. However, it also allows measures which are necessary to protect human, animal or plant life or health and relating to the conservation of exhaustible natural resources if such measures are made effective in conjunction with restrictions on domestic production or consumption. EU CBAM aims to prevent the carbon leakage and reduce greenhouse gases. This article reviews the ways to apply the CBAM in the regulation, legal status of EU CBAM and possibility of applying Article 20 of GATT. It reviews the legal characteristics of EU CBAM whether it is financial measures or environmental measures. This article concludes EU CBAM could be charges in WTO which can be subject of Article 3 as financial measures. Even though EU CBAM is not financial measure but environmental measure, it can be subject of Article 11. However, it can be permitted as exception measures based on Article 20 for environmental protection. In addition, it also provides implication of EU CBAM for Korean environmental and trade policy.
