EU 탄소 국경조정제도의 WTO 합치성 검토 - TBT협정을 중심으로 -

EU는 “탄소누출(Carbon Leakage)” 문제를 해결하고 공정한 경쟁 환경 조성을 위해 CBAM을 도입했다. EU 입장에서 온실가스 감축목표 달성을 위해 온실가스 다배출 산업(carbon intensive industry)에서의 비용 상승과 경쟁력 약화에 대한 업계의 우려를 해소하고 산업경쟁력 보호를 동시에 달성하기 위한 제도를 도입할 필요가 있다고 보았다. 이는 WTO 규범에 위반될 뿐 아니라 EU의 교역대상국의 무역보복조치를 초래하여 무역전쟁을 야기할 수 있다는 비판이 있고, 우리나라의 주력 수출 상품인 철강, 시멘트 등의 수출에도 피해가 우려가 제기되고 있다. 그간 주로 CBAM 등 탄소국경조정제도의 WTO 합치성(WTO-compatibility) 여부에 대한 논의는 GATT 제2조의 국경세 조정, GATT제3조의 내국민 대우, GATT제20조의 예외 조항 중심으로 논의되었으나, 탄소국경조정에 대한 분석과 대응전략 마련을 위해서는 GATT상 국경세 조정 및 내국민 대우 등 기존의 통상규범의 분석틀과 시각에서 벗어난 보다 창의적이고 미래지향적인 접근법을 검토할 시점에 도달한 것으로 보인다. 본고에서는 WTO협정중 “제품의 공정 및 생산과정”을 협정 규율 대상으로 하고 있는 TBT 협정의 적용 여부 및 TBT 협정 주요 규정에 대해 검토했다. 향후 국내외 환경 변화에 따라 CBAM과 같은 공정 및 생산방식(PPM: Process and Production Methods)에 대한 규제들이 갈수록 늘어나고 더욱 복잡한 형태를 띄게 될 것이고, 국내법상 정당한 국내 규제 주권과 국제기구의 원칙과 규정들간 충돌을 야기하는 사례가 빈번해 질 수 밖에 없다. 이러한 상황에서 TBT협정상 PPM 개념과 기술규정의 적용 범위에 대해 아직 합의된 견해는 없으나, 동 개념에 대해 보다 적극적으로 확장된 적용을 검토해볼 필요가 있을 것으로 본다. 동 CBAM에 대한 문제를 분쟁해결기구로 제소하는 것보다는 WTO 차원에서도 TBT위원회 등에 문제제기를 통해 보다 동 개념들에 대한 상호 이해를 제고하고, 상호 합의가능한 해결 방안을 모색할 수 있으며, 분쟁해결기구에 제소하는 것은 무역 보복 유발 가능성 등을 감안할 때 최후의 수단으로 선택되는 것이 바람직하다고 볼 수 있다.
Abstract
The EU introduced Carbon Border Adjustment Mechanism(CBAM) to solve the “Carbon Leakage” problem and level playing field. From the EU's point of view, in order to achieve its greenhouse gas reduction target, it is necessary to introduce such a mechanism to address concerns of carbon-intensive industries about rising costs and weakening competitiveness and to simultaneously maintain its industrial competitiveness. There have been lots of discussions on whether the Border adjustment mechanism is in violation of WTO norms and criticisms that it can cause trade wars by causing trade retaliation by its trading partners. Discussions up to now on the WTO-compatibility of carbon border adjustment systems such as CBAM have been mainly focused on border tax adjustment in Article 2 of GATT, national treatment in Article 3 of GATT, and exceptions in Article 20 of GATT. However, in order to analyze border adjustments in-depth and prepare for substantially effective measures, a more creative and future-oriented approach could be explored, which might depart from the framework and perspective of existing trade norms such as border tax adjustment and national treatment under GATT. In this paper, the application of the TBT Agreement, which deals with the “process and production method” among the WTO agreements, was reviewed and the main provisions of the TBT Agreement analyzed. Due to rapid changes in the domestic and foreign environment, regulations on process and production methods (PPM) like CBAM will increase and take on a more complex form. In this situation, although there has not yet been any consensus on the scope of PPM concept and “technical regulations” under the TBT Agreement, it is necessary to examine whether it could be applied to the new regulations like CBAM. Rather than bringing the CBAM issue to the WTO dispute settlement body, it could be desirable firstly to raise the issue to the TBT committee and reserve the dispute settlement body as a last resort in consideration of the possibility of inducing trade retaliation.
