미국은 EU와의 글로벌지속가능철강협정(US-EU GSSA), EU는 탄소국경조정제(CBAM)를 각각 진전시켜 탄소 고배출 제품에 대한 통상규제에 나서고 있다. 이 두 기제는 기후 변화에 직면하여 철강 산업 등의 탄소배출을 줄이는 환경 보호가 공통의 목적이지만, 개발도상국 입장에서는 보호 무역주의로 인식된다. WTO의 비차별 원칙을 위배하는 조치여서 국제통상법적인 관점에서 논란의 여지가 많다. 본 연구는 GSSA와 CBAM의 배경과 주요 내용을 분석하고, 1980-2021년 GATT/WTO의 양허관세, 환경 예외 조항과 안보상의 예외에 원용된 판례와 법리를 정리한다. 그리하여 국제통상법적으로 정당화할 수 있는 것인지를 분석한다. 또한, WTO 보조금과 반덤핑 협정과 관련된 주요 이슈도 다룬다. 한국은 수출 주력인 철강 산업이 그 환경 규제에 직면해 있다. 이 연구는 한국 철강 산업은 물론 중국, 일본과 인도의 그것에 미치는 영향, 그 국가들의 대응 전략을 살펴본다. 그리고 국제 통상 분쟁과 협력의 가능성을 탐색한다. GSSA와 CBAM의 유사성과 차이점 비교를 통해 한국이 글로벌 환경 규제의 새로운 흐름 속에서 전략적으로 어떻게 위치를 잡아야 할지에 대한 시사점을 도출해 본다. 나아가 국제 사회에서 한국이 어떻게 더 포용적인 통상 파트너로서, 글로벌 통상의 지표 국가(indicator)로 자리매김할지를 제안한다.
Abstract
This study analyzes the progression of the US-EU Global Arrangement on Sustainable Steel and Aluminum(GSSA) and the EU's Carbon Border Adjustment Mechanism (CBAM), which are pivotal in regulating trade of high carbon-emitting products like steel amid climate change. While these initiatives aim to reduce carbon emissions in industries such as steel for environmental protection, they are perceived as protectionist measures by developing countries, raising potential conflicts with the WTO's non- discrimination principle. This research delves into the background and key elements of GSSA and CBAM, and evaluates their alignment with international trade law by examining GATT/WTO Schedules of Concessions, environmental and security exceptions cases during the period from 1980 to 2021, to assess their compatibility. The study also covers major issues related to WTO subsidies and anti-dumping provisions. Furthermore it delves into the impact of these environmental regulations on the steel industries of key exporting countries, not only South Korea but China, Japan, and India also and explores their response strategies. The potential for international trade disputes and cooperation in light of these developments is also touched upon. By comparing the similarities and differences between GSSA and CBAM, the study draws implications for South Korea's strategic positioning in the evolving global environmental regulatory landscape. Additionally it proposes how South Korea can establish itself as a more inclusive trading partner and an indicating state in global trade standards.
