Abstract
The Proposal for the EU CBAM Regulation announced by the European Commission falls under the technical regulation and seems to be highly unlikely to be compatible with the WTO TBT Agreement. After the outbreak of COVID-19, countries with big markets have adopted their unilateral environmental policies, such as the CBAM, in accordance with their own domestic law. These policies tend to maintain protectionist purposes to protect their domestic industries. Accordingly, if a country's environmental regulation adversely affects international trade, the legal issue whether it violates the existing WTO rules could be raised. In order for each country's environmental regulation not to cause trade conflicts with other countries, an unilateral environmental policy adopted by a country must be carefully devised in accordance with well-established international norms such as international environmental agreements and the WTO Agreement such as TBT Agreement. This paper aims to analyze the legal as well as technical issues embedded in the EU CBAM proposal and proposes the blueprint on how the EU CBAM should be designed and implemented complying international legal norms. Without the global carbon price, the problem of carbon leakage is inevitable. Therefore, a transnational environmental policy adopted by each state should not pursue prohibiting the carbon leakage, which would not result in reducing carbon emissions. Considering the fact that Korea has maintained export-oriented trade structure and carbon-intensive industries, such as a steel sector, have driven the economic growth of Korea, the current global trend toward unilateral environmental policy sends dangerous signal for us. It is expected that this paper would contribute to devising the national strategy to counter this unilateralism and to protect Korean industries.
