해외에서는 영리추구와 공공선의 실현이라는 두 가지 목적을 동시에 만족시키고자하는 목적에서 탄생한 새로운 형태의 기업이 사회적 기업이라면, 국내에서는 이를 정부가 주도하여 인증을 거쳐 육성함으로써 정부가 제공하기에 역부족인 사회서비스를 제공하고 고용을 창출하는 수단으로 사용하는 것을 목적으로 사회적 기업이라는 제도를 도입하였다. 조직 형태, 사회적 목적 유형, 서비스 분야별 분류에 있어 다양함을 보이는 사회적 기업의 다수가 상법상 회사의 형태를 띠고 있으며, 또 대부분이 중소기업임은 사회적기업의 자생력과 성장이 중소기업으로서의 특징과도 무관하지 않다고 할 수 있다. 즉 여러 차례 개정을 거친 현재의 「사회적 기업 육성법」 상의 내용은 중소기업으로서의 사회적기업의 측면을 고려하고 충실히 반영하지 못한 면이 있으며, 이는 현행법의 실효성 문제와 직결된다. 이를 개선하기 위해 「사회적 기업 육성법」의 정책적, 법적 과제를 살펴보고, 발전 전망을 고찰한다.
Abstract
A type of corporate entity that pursues two purposes – profit generation and public good – is realized in various forms of public interest companies overseas, while a rather formal ‘social enterprise’ was formatted and promoted by the government to help with lowering unemployment rates and providing social services in Korea. Vast majority of social enterprises in Korea are in the form of legal corporation albeit their structure, purpose in public benefit, and service type that they provide are all in variety, and almost all are small and medium sized businesses. This proves that the growth and independence of social enterprises are not different from the nature of being small and medium sized businesses. Current Social Enterprise Promotion Act (“The Act”), although amended several times for improvement, does not quite reflect social enterprises as small and medium businesses, and this results in the effectiveness of the current Act. In the hope of drawing suggestions for change, this paper examines tasks under political and legal aspect of the Act and reviews prospects of the Act.
