사회적기업법제의 현황과 개선과제

사회적기업이란 사업으로부터 발생한 이익을 주주나 사업주를 위해서가 아니라 사회적 목적을 위해 재투자함으로써 사회적 문제를 해결하고 지속가능한 사회를 만드는 데 기여하고자 하는 기업을 말한다. 2007년 「사회적기업육성법」이 시행된 이래 사회적기업은 양적으로도 비약적 성장을 하였을 뿐 아니라 취약계층의 일자리 창출에도 크게 기여하고 있어 정부도 다양한 측면에서 적극적으로 지원을 하고 있다. 다만 「사회적기업육성법」상 사회적기업의 개념이 지나치게 취약계층에 대한 고용창출 및 사회서비스의 제공에 치우쳐 있다 보니 사회적기업이 우리 사회가 직면한 수많은 문제 해결을 위한 역할을 하는 데 제약이 따를 수 밖에 없다. 사회적기업이 추구할 가치는 취약계층에 대한 고용창출 외에도 환경문제, 지속가능한 성장, 계층･성･연령 간 갈등 해소, 비대면 서비스 확산에 따라 급증하는 새로운 문제의 해결 등 사회변화에 따라 계속 진화한다는 점에서 보다 광범위한 개념 정의가 필요하다고 할 것이다. 또한 사회적기업에 대한 정부의 지원이 인건비 중심으로 이루어지다 보니 과잉 고용을 초래하고, 지원 중단과 함께 폐업의 위기에 처하게 되는 경우가 빈번하게 발생하여 왔다. 사회적기업이 지나치게 정부나 지자체의 지원금에 의존하면 자생력을 잃고 사회적 목적도 제한적 효과에 그칠 수 밖에 없다. 다른 한편 취약계층 고용비율, 사회서비스 제공 비율 등의 법정 기준을 통과한 조직만을 사회적기업으로 인증하다 보니 소규모 기업은 인증요건을 충족하지 못해 정부의 지원을 받지 못하게 되고, 그로 인해 사회적기업으로 성장하는 데 어려움을 겪게 된다. 엄격한 인증제도가 다양한 사회적기업의 성장과 발전에 걸림돌로 작용하게 된 것이다. 그밖에 경쟁력이 약한 사회적기업들이 판로 개척에 어려움을 겪고 있다는 점도 문제로 지적되고 있다. 이에 사회적기업에 대한 공공기관 우선구매제도가 보다 활성화되어야 한다는 목소리도 높아지고 있다. 이와 같은 배경 하에 이 논문은 우리나라 「사회적기업육성법」의 연혁을 살펴본 후 현행법의 주요 내용을 목적, 유형, 인증제 및 지원제도 등을 중심으로 검토한다. 이어 현행법의 한계 및 문제점이 무엇인가를 파악한 후 그 개선방안을 제시하고자 한다.
Abstract
Since the Social Enterprise Promotion Act took effect in 2007, social enterprises have not only grown in quantity but also contributed greatly to the creation of jobs for the vulnerable people, so the government has supported social enterprises in various ways. However, the concept of social enterprises under the Social Enterprise Promotion Act is too biased toward job creation and the provision of social services to the vulnerable people, which is a constraint on social enterprises to play a role in solving many social problems facing our society. In addition to creating employment for the vulnerable people, social enterprises need a broader definition of concept in that they should continue to evolve as society changes, such as environmental problems, sustainable growth, conflict and polarization between classes, and other problems. In addition, government support for social enterprises has often led to excessive employment and the end of business with the suspension of support. If social enterprises rely too much on subsidies from the central government, they will lose their self-sustaining power. On the other hand, only organizations that pass legal standards such as employment ratio and social service provision ratio of vulnerable groups will not be supported by the government because they do not meet certification requirements. The strict certification system has become a block to the development of various social enterprises. Another problem is that social enterprises with weak competitiveness are having difficulty pioneering their markets. As a result, there are growing voices that the priority purchase system of public institutions for social enterprises should be activated more. This paper examines the history of Korea's Social Enterprise Promotion Act and examines the main contents of the current law around the purpose, type, certification system, and support system. It will then identify the limitations and problems of the current system and suggest ways to improve them.
