현재 국내에서는 식품의약품안전처로부터 허가를 받아 사용 중인 디지털 치료기기가 2호까지 출시되었다. 이 글은 디지털 치료기기가 국내에서 허가받기까지 관련된 법제도를 개관하고 검토하여 이를 비판적으로 분석하고, 이와 관련된 국외의 주요 법제를 간략히 검토하여 앞으로 우리 디지털치료에 적절한 법적 규제의 방향을 모색하는 것을 목적으로 한다. 우선, 이를 위해 디지털치료의 개념을 짧게 논한 이후에 디지털치료와 관련된 법제를 검토하고 분석한다. 이와 관련하여 국내 의료기기의 정의와 판단기준, 의료기기의 사용절차와 기준, 의료기기 및 의료기술 평가기준 및 기간을 살펴보고, 범위를 좁혀 혁신의료기기 지정절차와 기준, 혁신의료기기소프트웨어특례, 혁신의료기기 지정 통합심사 등을 검토한 이후에 관련 문제점을 논한다. 다음으로 우리의법제와 비교하기 위하여 앞의 법제 비판과 관련된 미국과 EU의 소프트웨어 의료기기 규제 법정책을 간략히 논한 이후에, 마지막으로 우리 디지털치료 관련 법제에 적절한 규제의 방향을 제안한다.
Abstract
Currently, in Korea, the second digital therapeutics that has been approved by the Ministry of Food and Drug Safety has been released. This article provides an overview and review of the relevant legal systems for digital therapeutics to be approved in Korea, critically analyzes them, and briefly reviews major foreign legal systems related to this to seek the direction of appropriate legal regulation for our digital therapeutics in the future. First, after briefly discussing the concept of digital therapeutics, the legal system related to digital therapeutics is reviewed and analyzed. In relation to this, we looked at the definition and judgment standards of domestic medical devices, the procedures and standards for use of medical devices, the evaluation standards and periods for medical devices and medical technology. After narrowing the scope and reviewing the innovative medical device designation procedures and standards, innovative medical device software special cases, and integrated review for innovative medical device designation, related problems are discussed. Next, in order to compare our legal system, we briefly discuss the software medical device regulation policies of the US and EU related to the criticism of the previous legal system, and finally, we propose an appropriate regulatory direction for our digital therapeutics-related legal system.
