본 연구는 정보화시대의 인터넷이 민주사회의 중요한 가치인 ‘표현의 자유’와 ‘명예의 보호’ 사이의 충돌 양상과 추동성을 분석했다. 특히 인터넷의 주요한 속성 중의 하나인 ‘익명성’을 기초로 형성된 정보화 시대의 익명 표현의 자유가 개인의 권리 침해와 충돌을 넘어서 어떻게 이들 두 가치를 상호 양립시키면서 발전시켜 나갈 것인가가 이 연구의 주요한 논점이다. 한국의 인터넷을 특징짓는 대표적인 문화가 댓글 문화라고 한다. 그리고 이 문화는 다른 선진국들에서 찾아보기 어려운 독특한 한국의 인터넷 문화라고 평가된다. 국가별로 다양한 인터넷 문화의 차이를 고려하지 않고 획일적으로 선진국의 규제시스템을 받아들여야 한다고 주장하는 것은 어불성설이다. 한국 사회 특유의 인터넷 발전과 그로 인해 파생된 부정적 인터넷 문화에 대한 자율규제는 건전한 사회질서 유지와 바람직한 인터넷 문화의 형성을 위한 근본이다. 이런 관점에서 볼 때, 인터넷으로 인한 사회적 문제에 대한 적극적인 대처 방안으로서 정책적 발전이 지속적으로 필요하다. 그것이 바로 건전한 인터넷 문화의 조성과 익명성의 폐해를 시정해 나가는 지름길이다.
Abstract
This study analyzed the collision aspect and the push between ‘freedom of expression’ and ‘protection of honor,’ which are important values of democratic society on internet in the information age. Especially, the main issue point in a study is how the freedom of anonymity expression in the information age, which was formed on the basis of ‘anonymity’ that is one of major properties of internet, proceeds with developing while allowing these two values to be mutually compatible beyond collision with violation of an individual’s rights. The representative culture of characterizing internet in South Korea is said to be the culture of reply. And this culture is evaluated as South Korea’s unique internet culture that is difficult to be found in other advanced countries. It is illogical to insist on the necessity of accepting regulation system of the advanced countries uniformly without considering difference in diverse internet cultures by state. The internet development peculiar to South Korean society and the autonomous regulation on negative internet culture, which was derived by it, are the foundation for maintaining the order of sound society and forming desirable internet culture. Seeing it from this perspective, the policy-based development is continuously needed as a method of positively coping with social issue caused by internet. That is just a shortcut of proceeding with forming sound internet culture and correcting evil influence of anonymity.
