학교폭력 방지를 위한 한국․일본의 비교법적 연구

초록

학교폭력 문제의 대응방안을 찾기 위해 최근 우리나라 사회가 심각한 고민에 쌓여 있다. 대구의 한 중학생 자살 사건으로 드러난 학교폭력의 실상은 가히 상상 이상의 것이었다. 그러고 보면 1980년대 이지메 유형의 학교폭력으로 일본 사회도 한동안 큰 충격에 쌓여 있었다. 일본의 학교폭력(폭력행위, 이지메, 무단결석, 자살)은 그 조사방법의 잦은 변경으로 정확한 추이를 파악하기는 힘들지만 1983년을 정점으로 일본의 청소년 범죄율은 점진적인 하강을 거듭하고 있다. 일본의 학교폭력에 대한 원인과 방지대책을 살펴보면 이에 대하여 정부 차원에서 오랫동안 많은 고민들을 하였다는 것을 알 수 있다. 즉, 학교폭력 방지대책이 30여년의 장기 프로젝트로 수정․변경되어 진화하였다는 점이다. 이것은 우리나라 학교폭력 대응방안 마련에 도움을 줄 수 있다. 현재 많은 위기와 한계를 극복하면서 세계의 선진 주역으로 성장하고 있는 우리나라는 학교폭력 문제로 엄청난 사회적 고통을 겪고 있다. 학부모와 교사뿐 아니라 일반인들은 학교라는 곳이 지식을 온전히 배우는 전당으로 알고 있다. 그런데 이곳이 오히려 괴롭힘과 폭력이 난무하는 장소라는 현실을 깨닫는다면 이에 대한 해결이 반드시 요구된다고 생각할 것이다. 특히, 교육과 학력을 중시하는 우리나라의 경우에는 학교폭력에 대한 해법을 찾는 길은 국가적 대업이라고 해도 과언이 아닌 것이다. 이에 따라 경제, 사회, 문화면에서 우리나라의 상황과 유사성이 많고 학교폭력과 이지메로 과거 큰 고통을 겪었던 일본의 경험과 비교하여 우리나라 학교폭력 문제에 시사성을 주려는 의도에서 본 논문은 연구되었다.

Abstract

In December 2011, a middle school student in Daegue province committed suicide because of school violence. This was not an isolated incident. Indeed, this suicide was the social emergence of a phenomenon perpetuated by the mass media, whose attention has converged on school violence, thereby robbing an entire generation of its innocence. That is, school violence threatens youths' lives like a kind of terminal cancer. In a global perspective, bullying (Ijime) as a form of school violence was a humiliating issue for many countries in the 1980s in Japan. The juvenile crime rate in Japan radically increased through the early 1980s. At that moment, the government started to create tougher policies, and state governments also legislated severe punishment policies. In the aftermath of these laws, many schools reformed their policies and practices regarding school safety. We are able to know that Japanese society has experienced school violence problems including Ijime for the long time, our school violence problems also appear similarly in South Korea. Rather, our school violence is extremely severe and pervasive in our society. A school is originally the place where learning information by teachers. Nevertheless, recent our schools are place where occurring to violent arenas like bullying, assault, and crime. Therefore, the finding of prevention for the school violence is the most important to maintain nation's great plan and prosperity. This thesis delicately analyses Japanese experiences in order to help resolving our school violence problems and refer to make appropriate statutes through the comparing policies and legal systems between South Korea and Japan.
