포괄적·점진적 환태평양경제동반자협정(CPTPP)에서의 불법·비보고·비규제(IUU) 어업 규제에 관한 연구

국제사회는 IUU 어업으로 인해 남획 상태에 있는 세계 어족자원을 보존하기 위해 다각적으로 노력하고 있다. 이러한 노력의 일환으로 2000년대 초반 국제연합과 국제사회는 최대 공동목표로서 해양자원의 보존 및 지속 가능한 이용을 열네 번째 지속가능개발목표로 선정하였다. 그리고 유엔식량농업기구(FAO)는 IUU 어업을 예방하고 방지하며 근절하기 위해서 IUU 행동계획 및 항만국조치협정을 채택하였다. 국제사회의 일련의 노력에도 불구하고, IUU 어업으로 인한 장기적이고 영구적인 피해를 해결하기 위한 실질적인 조치는 여전히 충분하지 않다. 이에 국제사회는 좀 더 효과적인 방법으로 IUU 어업을 근절하기 위하여 세계무역기구 도하개발어젠다와 포괄적·점진적 환태평양경제동반자협정과 같은 분쟁해결제도가 포함된 통상협정에서 IUU 어업을 근절하기 위한 규정을 두고 있다. 역사적으로 우리나라는 주변국들의 IUU 어업으로 많은 고통과 피해를 받기도 하고, 우리나라가 예비 IUU 어업국으로 지정된 바도 있다. 그리고 우리나라의 원양어선들은 세계의 여러 원양해역에서 조업하고 있으므로 IUU 어업에 대한 국제적 규제에 의거한 연안국, 항만국 및 국제수산기구의 강화된 어업활동 감시를 받을 수 있다. 이러한 상황에 대응하기 위하여 본고는 IUU 어업을 규제하기 위한 국제적 논의 동향, 특히 TPP에서의 IUU 어업 규제 내용 및 그 파급효과에 대해서 살펴보고, 대응 방안을 제시하고자 한다.
Abstract
The international community is making various efforts to preserve the world's overfished fishery resources due to IUU fishing. As part of this effort, the United Nations and the international community selected the conservation and sustainable use of marine resources as the 14th sustainable development goal in the early 2000s. In addition, the United Nations Food and Agriculture Organization(FAO) adopted the IPOA-IUU and Agreement on Port State Measures Despite a series of efforts by the international community, practical measures to address long-term and permanent damage from IUU fishing are still not sufficient. In order to eradicate IUU fishing in a more effective way, the international community has regulations to eradicate IUU fishing in trade agreements that include disputes settlements such as the World Trade Organization Doha Development Agenda and the Comprehensive and Progressive Trans-Pacific Partnership. Historically, Korea has suffered and suffered a lot from IUU fishing by neighboring countries, and Korea has been designated as a preliminary IUU fishing country. And since Korea's deep-sea fishing boats are operating in various ocean waters around the world, they can be monitored by coastal countries, port countries and international fisheries organizations under international regulations on IUU fishing. To respond to this situation, the HQ intends to examine trends in international discussions to regulate IUU fishing, especially the content of IUU fishing regulations and their ripple effects in TPP, and suggest countermeasures.
