이 논문의 목적은 태아의 신분을 신학적으로 규명하여 한국교회에 제공하는 것이다. 한국 헌법재판소가 낙태를 죄로 간주하고 낙태 행위를 처벌하는 형법의 일부 내용을 개정할 것을 주문했다. 왜냐하면 현재 형법이 헌법이 보장하는 개인의 행복추구권을 희생하면서 태아의 생명권을 일방적으로 보호하기 때문에 헌법 정신에 합치하지 않기 때문이다. 헌법재판소는 형법을 개정해서 이 법을 통해 태아의 생명권과 아울러 여성의 자기 행복추구권을 함께 균형있게 보호해야 한다고 요구했다. 이 논문은 먼저 헌법재판소의 인간 이해의 문제점을 검토한다. 헌법재판소는 태아가 모태 밖에서 스스로 살 수 있는 능력을 갖게 될 때부터 태아를 인간으로 간주한다. 이 논문은 헌법재판소의 이런 기능론적 인간 이해가 지닌 문제를 철학적으로 비판한다. 이어 태아는 잠재적인 인간이 아니라 완전한 인간임을 신학적으로 분석한다. 전통적으로 교회는 인간의 존엄한 이유를 사람이 하나님의 형상을 지니고 있기 때문이라고 믿고 고백해 왔다. 만약 태아가 일반 사람처럼 하나님의 형상을 지니고 있다면, 태아도 인격체로 이해하지 않으면 안된다. 이 논문은 성경의 여러 구절들과 가르침을 신학적으로 분석하여 태아도 하나님의 형상을 지닌 인격체임을 규명한다. 마지막으로, 형법을 기독교적 가치에 더 가까운 내용으로 개정하기 위해 노력하는 교회를 위해 실제적으로 필요한 몇가지 지침을 제공한다.
Abstract
The aim of this paper is to conduct a theological examination for the Korean Church concerning the status of an unborn child (or fetus). The Korean Constitutional Court has ordered an amendment to certain provisions in the current penal code that criminalize and punish abortion. This is because the current penal code unilaterally prioritizes the right to life of the unborn, overshadowing the right to the pursuit of happiness guaranteed by the constitution, which deviates from the constitution's spirit. The Constitutional Court has called for a revision of the penal code to ensure a balanced protection of both the unborn's right to life and the right of women to pursue happiness. First, this paper reviews the Constitutional Court's understanding of persons. The Court regards a fetus as a person only from the point when it can live independently outside the womb. This paper critically examines the Constitutional Court's functionalist view of persons. Second, it theologically analyzes that the fetus is not a potential person but a full person. Traditionally, the church has held and proclaimed that human dignity arises from the belief that humans bear the image of God. If a fetus embodies the image of God like any other person, then it must also be recognized as a person. This paper delves into various biblical verses and teachings to clarify that a fetus is a person bearing the image of God. Lastly, the paper offers practical guidelines for the church, which aims to amend the penal code to align more closely with Christian values.
