Abstract
On April 11, 2019, the Constitutional Court of Korea declared the abortion provisions of the Criminal Act unconstitutional and called on the National Assembly to revise the law by December 31, 2020. However, no legislative amendments were enacted by the deadline, and as of 2025 the relevant provisions remain legally ineffective. This prolonged legislative vacuum has led to uncertainty in the application of the law and increased the risk of arbitrary state intervention, thereby threatening legal stability. This paper seeks to offer proposals for legislative reform concerning abortion. It begins by analyzing the 2019 Constitutional Court decision, focusing on its framing of fetal right to life and the pregnant woman’s right to self-determination as fundamentally opposing values. This paper argues that such a binary approach obstructs constructive legal reform and demonstrates that, for productive legislative discussions to take place, the fetal right to life must be rejected. It then calls for a shift toward a framework focused on the limits of self?determination in the context of public interest. Abortion regulations should not aim to balance two conflicting constitutional rights, but rather assess to what extent a woman’s right to self-determination may be justifiably limited in the public interest of protecting fetal life. Based on this perspective, this paper proposes how reasonable periods for differentiated abortion restrictions can be determined through a brief examination of brain death. It proposes that abortion restrictions and conditions be adjusted around two key points: the 8th week of pregnancy, when embryonic life begins, and the 22nd week, when legal recognition of fetal right to life might be considered.
