도입 초창기부터 전자투표제를 둘러싼 찬반 논쟁에도 불구하고, 선거 현대화를 위한 하나의 방법으로써 전자투표가 지배적인 투표방식이 될 것이라는 주장이 힘을 얻어왔다. 그 결과 전자투표제는 지난 10여 년 간 많은 나라들에서 새로운 투표방식으로 채택되었고, 전면 실시를 목표로 한 시험들이 지속적으로 추진되어 왔다. 하지만 2009년 3월 2일 전자투표제가 위헌이라는 독일 헌법재판소 결정과 2006년 10월 네덜란드의 TV 방송국이 시연회를 통해 보여 준 전자투표의 조작 가능성은 1990년대 중반 이후 전 세계적 차원에서 전자투표제가 빠른 속도로 확산될 것으로 내다 본 낙관론자들의 입지를 약화시키고 있다. 이 상황에서 본 연구는 1990년대 후반 이후 상대적으로 빠르게 진행되던 네덜란드와 독일의 전자투표제 도입과 확산 과정을 중단시킨 결정 요인을 추적하고 분석해 보고자 하는 데 목적이 있다. 본 연구는 우선 1990년대 중반 이후 본격화된 네덜란드와 독일의 정보화 추진 과정과 현황 및 그간 추진되어 온 양국에서의 전자투표제 도입 과정과 실시 현황을 정리하고, 전자투표제의 기술적 여건과 아울러 전자투표제의 도입을 촉진시킨 양국의 제도적 조건과 환경 조성을 위한 정책적 노력 등을 종합적으로 추적한다. 그리고 이러한 흐름과 달리 최근 양국에서 전자투표제를 중단하게 된 과정과 결정 요인을 정리하고 분석한다. 전자투표제의 중단과 관련된 해외 사례 연구는 그간 낙관적인 관점에 집중돼온 국내 연구와 관련하여 시사하는 바가 크다. 전자투표제 중단을 둘러 싼 최근의 네덜란드와 독일의 사례를 연구하는 작업은 국내의 전자투표제 전망을 이해하는 것과 무관한 일이 아닐 것이다.
Abstract
Despite controversies around e-voting in earlier days, claims forecasting that it will be dominant voting method as a way to modernize an election have been gaining momentum. As a result, e-voting has been adopted as a new voting method in a number of countries over the last ten years, further piloted for a full-fledged undertaking in some countries. Following the decision by the German Constitutional Court on March 2, 2009 that e-voting is against the constitution, and possible manipulation show-cased by the Dutch TV broadcasting company in October 2006 tremendously weakened the position of optimism having expected its rapid global expansion. Against these backdrops, this paper intends to analyze main factors of introducing and suspending e-voting both in Germany and the Netherlands, where introduction and expansion of e-voting were relatively ahead of others. For that matter, the paper will see the process and current status of informatization and e-voting in both countries. Also it follows technical achievements, and institutional as well as political endowments conducive to e-voting in the countries. In contrast with these trends, the paper will look into the process and primary factors that suspend e-voting in Germany and the Netherlands. Studies on the cases of e-voting suspension in other countries shed some lights upon the domestic studies that placed too much emphasis on the optimism. Study on the German and Dutch cases of e-voting suspension is possibly linked to the future prospects of e-voting in Korea.
