CISG는 국제물품매매에 관한 한 국제적 통일법으로서의 중추적 역할을 감당하고 있다. 현재 CISG는 개별국가의 법원 또는 중재판정부 등에서 적용 및 원용된 각양의 판결례를 집적해 두고 있는데 이는 공식 기관지인 UNILEX를 통해 지속적으로 공표되고 있다. 현재 국가별 UNILEX 사례는 총 43개국 979건에 달하고 있는데 이 중에서 가장 많은 분쟁사례를 집적하고 있는 국가는 EU의 실질적 주도국 독일로서 총 211건을 보유하고 있다. 이는 전체 대비 약 22%에 해당한다. 본고는 CISG가 적용된 독일 법원의 판결례를 CISG 조문별로 구분하고 상위 적용빈도를 엿보이고 있는 CISG 조문에 대한 법적 기준으로서 계약당사자의 책임체계를 도출한 논문이다. 본고에서 CISG 조문 인용에 주안점을 두고 있는 이유는 CISG 조문 인용빈도에 비례하여 분쟁 발생 가능성이 클 것이라는 사실을 고려하여 CISG 적용에 따른 분쟁의 예견 가능성을 담보하고 이에 부합하는 법적 안정성을 도모하기 위함에 있다. UNILEX에서 선별한 독일 법원의 CISG의 인용빈도별 우선순위는 차례로 연체금액의 이자(제78조), 계약 부적합의 통지(제39조), 적용상의 기본원칙(제1조), 매수인의 계약해제권(제49조), 적용사항과 비적용사항(제4조), 물품검사 시기(제38조), 협약의 해석원칙(제7조), 손해액 산정의 일반원칙(제74조), 대금지급의 장소(제57조), 중대한 계약위반의 정의(제25조), 물품의 계약 적합성(제35조), 당사자 진술 또는 행위의 해석(제8조) 등이다.
Abstract
As an international uniform law on the international sale of goods, CISG operates UNILEX, an official journal, in order to generalize the legal standards of CISG to contracting parties engaged in international commerce. UNILEX provides clear legal standards for CISG and has published various judgments that have been applied and invoked by courts or arbitral tribunals in individual countries. This paper analyzes Germany's CISG citation index, which collects the most judgment cases in UNILEX, and analyzes the liability system of contracting parties as a legal standard for CISG. First of all, this paper classifies judgment cases of German courts to which CISG has been applied by CISG clause and analyzes the liability system of contracting parties for CISG clauses, which have a higher application frequency. The reason this paper focuses on citing the CISG article is to ensure the possibility of foreseeability in various disputes according to the application of the CISG and to promote legal stability corresponding to it. In short, the purpose of this study was to derive the liability system of the contracting parties from the legal standards regarding the CISG Articles in consideration of the fact that the possibility of a dispute would be high in proportion to the frequency of citation of the CISG Articles.
