Abstract

The European Union’s Carbon Border Adjustment Mechanism (CBAM) is a key regulatory instrument designed to prevent carbon leakage from non-EU countries and ensure price parity with the EU Emissions Trading System (EU ETS). Focusing on the recognition mechanism for the equivalence of foreign carbon prices—one of the core variables of CBAM—this study conducts a law-and-economics analysis of how the net CBAM burden for Korean exporters changes when the Korean Emissions Trading Scheme (K-ETS) satisfies the EU’s recognition requirements. Incorporating the CBAM Regulation and its transitional implementing rules, the study derives the legal structure of foreign carbon-price equivalence and develops a quantitative simulation model based on a formally defined net-burden cost function. The analysis finds that when interoperability or equivalence is granted, the net CBAM burden on Korean exports of steel and aluminum—major CBAM-covered sectors—may be reduced by approximately 40–70 percent. Policy implications include: (1) pursuing a Korea–EU agreement on carbon-price interoperability, (2) strengthening the price signal of the K-ETS, and (3) improving the electricity attribute-tracking system for indirect emissions. This study provides a law-and-economics foundation for discussing CBAM–K-ETS interoperability and offers practical guidance for strategic planning by Korean firms and policymakers targeting the EU market.
