민법개정안의 성년후견제도와 피후견인의 신상보호

국회 본회의에 회부된 민법개정안(대안)은 이제까지 법률 속에서 소외되어 있던 인간의 능력에 관한 문제를 면밀히 고찰하여 폭넓게 수용하려고 노력한 결과물이다. 세계적으로 성년후견제도는 이미 정착 단계에 와 있는데, 다소 늦었지만우리 민법에서 이를 수용하기로 한 것은 매우 타당하고 더욱이 가장 최근에 입법을 시도한 것이니 만큼 기존에 성년후견제도에 관하여 논의되어 왔던 내용들을 담을 수 있어서 제4세대 성년후견제도로 칭하여도 손색이 없을 정도이다. 이 글에서는 우리 민법개정안이 만들어지기까지 서구에서 이루어진 입법과정을 기술하고, 그 과정에서 나타난 논의의 핵심이라고 할 수 있는 ‘신상보호’가 민법개정안의 특징이자 장점으로 수용되게 된 것, 그리고 여러 의원들이 각계 각층의 의견을 수렴하여 다양한 개정안을 발의하였고 그 안들과 정부가 발의한 민법개정안이 국회에서 조율을 거치는 과정에서 신상보호에 관하여 상당히 중요한조문인 개정안 제947조의2 제5항이 삭제된 것, 그리고 최종적으로 제외국의 신상보호에 관한 규정들을 간략히 기술하여 비교함으로써 개정안 제947조의2 제5항이 어떤 의의를 갖는 것인가를 결론적으로 서술하였다.
Abstract
From the close of the 20th century to 21st century, many countries in the western nations have established the adult guardianship system through reconsidering the legal incompetence system that causes public opinion demanding revision or abolition of that system. According to public opinion, Ministry of Justice set to revision work with great eagerness and presented a revised bill (Civil Law) to the Assembly. The subcomittee passed the bill in January 11st, 2011. At last, the legal incompetence system will be fully eliminated in July 1st, 2013. Characteristic of the adult guardian is as follows; firstly, by altering the concept of capacity -so called ‘all or nothing’- in the legal incompetence system of current Civil Law into a “relative” one, the bill set value on remaining capacity; secondly, according to his/her remaining capacity, his/her own decision on his/her affairs will be respected; thirdly, contrary to what the legal incompetence system set value on managing properties, the adult guardian system emphasized the “personal welfare”. However, the clause 5, Art. 947-2 was eliminated in the process of tuning many bills on the adult guardian system. It is really regrettable that the subcommittee eliminated the clause which concerns the wholeness of the ward's body, freedom to reside and right to move, correspondence, freedom of residence, a serious infringement of privacy.
