재난패러다임의 전환과 재난법제의 설계방향

최근 국내․외에서 발생했던 자연적/사회적 재난과 그 대응과정을 통해 공공정 책의 주요 아젠다로서 재난법제에 대한 새로운 인식이 요청되고 있다. 재난법제에 관한 연구는 재난개념의 인식에서 출발되어야 한다. 종래 재난은 신정론적 관점에 서 신의 의지로 이해되었으나, 점차 자연의 돌발적 현상과 그에 대한 예측과 재난 연구와 재난공학으로 발전되었으며 이제는 재난이 자연적 요소 보다는 사회구조 의 취약성이라는 재난패러다임의 변화를 맞이하고 있다. 이와 같은 재난 컨셉의 변화에 따라 재난법제의 설계원칙에서도 새로운 접근이 필요하다. 재난법제의 접근은 정상과 예외(긴급・위기상황)의 공권력의 대처에 대한 법적 인 관리와 책임의 내용으로 이해된다. 이와 같은 재난관리와 책임의 새로운 인식 은 재난상황에 대한 시민들의 안전에 대한 권리의 인정에서 출발하고 있음을 유 럽인권법원의 판례를 통해 확인할 수 있다. 재난에 대한 보상은 불법행위법 만으 로는 한계를 가지며, 피해자의 보상이 보험시장의 배분과 공적 보상제도를 통해 보완되어야 한다. 또한 재난법제의 설계원칙 과정에서 재난에 대한 비난책임은 위 험관리 종사자 개인과 사회시스템에 대한 비난책임의 적정한 조정의 과정을 거쳐 야 할 것이다. 종래 재난관리의 주체의 귀속과 규제권한을 중심으로 한 전통적 법 적 접근은 마치 백사장 금긋기와 같은 정책결정자의 이성적 환상의 오류를 가져 올 수 있다. 이제 재난은 점진적인 사회현상으로 이해되어야 하고, 재난의 관리와 책임 및 보상에 관한 법적 선택은 사회의 재난관리 방식과 책임의 재배분이라는 요구를 수용하면서 비난책임의 조정을 개인이 아닌 사회시스템으로 전환하는 방 향으로 전개되어야 할 것이다.
Abstract
Disasters and the management of that is central main agenda and public policy of modern many countries including Korea. Disaster, especially nature disaster was understood as acts of God and nature, but we can find it can be regarded as social vulnerability exposed by natural hazard. This study argues that the shift in how a disaster paradigm is changed and its importance of concept has a essential role to design our legal system about disaster management and accountability. We consider the role of ‘Disaster law’ is the regulation of disaster response and allocation of accountability and we analysed tradition legal tradition about the dichotomy of normalcy and emergency. But the excption in emergency situation does not allow the substitution from democracy to dictatorship. The disaster management is considered as a human right and European Curt of Human Right show the refutation against exceptionalism. Disaster responsibility could be allocated tort law system and public fund and public compensation system. The approach mainly focused on person error could be lead to a finding a line in the sand and so we propose the balance between an effective disaster management legal design accepting the change of “Disaster” paradigm.
