Abstract
The purpose of the article is to study the historical background of international human rights law in terms of the non-Western perspective. The research question is “What was the meaning of human rights for the non-Westerners during the formative period of international human rights law?” This paper concentrates on the preparatory moments of the international human rights covenants. It will cover how the Universal Declaration of Human Rights (UDHR) could have been understood by the non-Westerners, and what could have been the meaning of human rights for them during the covenant formative period. The first part of the article will discuss the driving force behind the establishment of the UDHR. For the Westerners, it could have been closely related to WWII and the atrocity of the Nazi. This, however, may not have been shared by the non-Westerners who have experienced the imperialism and colonialism before WWII. Their concerns for human rights seem to have been brought out of their particular experience as well. This seems to be manifested in the preparatory documents of the covenant. It seems the idea of international development played a role. This article is significant as the history of international human rights law is often neglected area. In particular, this article could contribute to the scholarship for ICESCR may need to be revisited in part if the historical background is considered.
