Abstract

This paper focuses on the human rights norms, which were established just after the World War II and which provided the right to science for everyone, and addresses the meaning of science in the early human rights regime and the questions have raised against the concept therein. The social situation of today is not the same as that of the early twentieth century. It would be impossible for us to understand correctly the contents of human rights norms that conform to the social structure unless we took into account the advancement of science and technology. And it can be said that it is necessary for us to rightly approach those norms from the context of their establishment in order to alter and rebuild the categories of the right to science and author’s right in accordance with the social reality of present days. This paper reviews the short history of the right to science, author’s right, and right to informed consent as well, and a few questions raised and re-raised in the course of the advancement of science and technology, and finally suggests several points which are supposed to be considered in the process of making human rights policies. It deals with (ⅰ) the questions raised in conceiving of scientific knowledge as global public goods, (ⅱ) the problems in understanding the nature of scientific knowledge from the point of view of the sociology of scientific knowledge, (ⅲ) the fundamental dilemma between the universality of human rights and the limited natural resources.
