본 연구는 지난 10년간의 법학전문대학원 운영에 관하여 객관적인 상황과 실제 운영과정에서 나타난 몇 가지 문제점을 도출해 보고, 이후 법학전문대학원 운영의 과제를 검토해 보는 것을 목적으로 한다. 여기에서는 특히 최근 쟁점이 되는 입시, 장학금, 실무경력교원, 법학과목 운영, 결원보충제도 등에 한정하여 운영 현황과 과제를 검토해 보았다. 첫째 장학금 제도와 관련해서는 현행 장학금제도가 장학금 제도의 취지와 저소득층 학생들의 교육기회를 실질적으로 보장하기 위하여 생활비 지급이 가능하도록 하는 조치와 성적별 장학금 제도의 최소한의 유지 내지 보장을 과제로 제시하였고, 둘째 입학전형과 관련하여 각대학의 자율성을 보장하도록 하는 보완조치를 요구하였다. 셋째 실무교육강화를 위한 조치로서 실무경력교원이 교육을 위해서 필요한 경우 겸직할 수 있는 근거규정을 마련해야 하고, 넷째 법과대학 폐지이후 법학과목의 안정적이고 체계적인 제공을 위한 교육부의 실질적이고 통일적인 가이드라인 제시를 요구하였다. 다섯째 현재 임시적으로 시행되고 있는 결원보충제도가 편입학제도로 대체되었을 경우 지방 법전원의 안정적인 운영이 불가능함을 지적하면서 결원보충제도의 영구적 운영을 제안하였다. 마지막으로 법전원 운영과 관련하여 법전원법 제3조에 규정되어 있는 국가 등의 책무에 관해서 다시 한 번 주목해야 한다는 점을 강조하였다.
Abstract
The purpose of this study is to elucidate some problems in the course of the last 10 years of the operation of law school and to examine the tasks of the operation of law school. In particular, I reviewed the current status and issues of the system, including scholarships, practical career professors, undergraduate legal education, vacancy supplementation, and so on. First of all, regarding the scholarship system, the current scholarship system has suggested that the provision of the scholarship system and the provision of the living expenses in order to guarantee the education opportunities of the low-income students. Second, I asked for complementary measures to ensure the autonomy of each university in the entrance examination Third, as a measure for strengthening practical education, it is necessary to establish a ground rule for practical career professors to be concurrently needed for education. Fourth, I requested the Ministry of Education to present practical and uniform guidelines for the stable and systematic provision of legal subjects, since the abolition of the law college, Fifth, suggesting permanent operation of the vacancy supplement system, pointing out that it is not possible to operate all the local law school in the event that the temporary substitute system is replaced with the transfer system. Finally, it emphasized that it is necessary to pay attention once again to the responsibilities of the state as stipulated in Article 3 of the Law School law
