초록

2010년 9월 22일 EU는 실험동물보호지침을 제정하여 같은 해 11월 10일자로 시행하고 있다. EU가 동물실험을 규제하고, 실험동물을 보호하기 위한 법적 규제를 하는 목적은 동물복지의 실현을 통한 인간복리를 증진하기 위함이다. 지침은 실험동물의 보호를 강화하기 위해 국제적으로 인정되는 “대체, 감소, 개선”이라는 ‘3R원칙’을 처음으로 EU법에 명문화하였다. 이를 바탕으로 지침은 ① 실험에 사용되는 동물의 번식, 사육, 관리 및 사용의 개선, ② 동물의 기원, 번식 및 표시, ③ 번식자, 공급자 및 사용자의 운영 및 ④ 실험에서 동물 사용과 관련된 프로젝트의 평가 및 승인 등과 관련하여 아주 엄격한 요구조건을 충족시킬 것을 규정하고 있다. 회원국들은 경과조치에 관한 일부 예외를 제외하고는 지침에 규정된 내용을 2013년 1월 1일부터 시행하고 있다. 하지만 지침은 여전히 개선해야 할 여러 문제점을 가지고 있다. 특히 지침의 회원국내 수용과 적용, 동물복지와 3R원칙의 적용 문제로써 대체실험법의 적용과 발전 및 영장류를 사용한 실험 등에 대해서는 해결해야 할 과제들이 적지 않다. 이와 같은 문제점에도 불구하고, 지침은 동물실험을 할 때 반드시 준수해야 할 국제적 윤리기준인 ‘3R원칙’을 명문의 조항으로 규정하여 대체적 접근의 개발을 의무화하고 있다. 또한 멸종위기종, 영장류, 야생동물에 대해서는 실험을 금지 또는 제한하는 등 동물의 권리를 보호하기 위한 여러 조치를 시행하고 있다.

Abstract

On September 22, 2010, the European Union(EU) enacted the Directive on the Protection of Animal Testing, which took effect on November 10 of the same year. The purpose of the EU to regulate animal testing and to provide legal regulations for the protection of laboratory animals is to promote human welfare through the realization of animal welfare. The Directive first stipulates the 3R Principles of "Replacement, Reduction, Improvement" in EU law to strengthen the protection of laboratory animals. The Directive includes ① improvement in the breeding, management and use of animals used in experiments, ② the origin, breeding and labeling of animals, ③ the operation of breeders, suppliers and users, and ④ the use of animals in experiments. It requires that very stringent requirements are met with regard to evaluation and approval. The Member States have implemented the provisions of the Directive from 1 January 2013, with some exceptions to transitional measures. But the Directive still have a number of problems that need to be improved. In particular, there are not many problems to be solved in the application of the Directive by the Member States, development of alternative methods based on the 3R Principle and experiments using primates etc. Despite these problems, the Directive mandates the development of an alternative approach by providing the prescriptive provisions of the “3R Principle,” an international ethical standard that must be observed when conducting animal testing. There are also a number of measures to protect animal rights, including banning or limiting experimentation on endangered species, primates and wildlife.
