COVID–19 유행병으로 야기된 의료행위·임상시험에서 몇 가지 형사법적적 쟁점

초록

이 글은 COVID 19 pandemic과 같은 예외적 상황에서 의료자원의 부족 문제에 직면했을 때 과연 누구에게 집중치료 역량이 할당되어야 하는 것인지, 이러한 선택의 문제와 관련한 의료인의 면책기준이 설정 가능한 것인지, COVID-19 백신개발과 임상시험과정에서 나타난 특징과 문제점, 이러한 백신 개발 임상시험의 피험자와 백신 접종 대상자 등의 동의 필요성과 제공정보의 내용ㆍ절차 등에 대해서 살펴보고 있다. 여전히 인류는 COVID 19 pandemic과 같은 예외적 상황에서 의료자원의 부족 문제에 직면했을 때 누구에게 치료자원이 할당되어야 하는 것인지에 대한 논의를 꺼려하고 있고, 최종 선택의 문제를 의료인ㆍ의료시설에 떠넘기고, 의료인의 면책을 논의하는 것은 불필요한 논쟁을 불러일으킬 것이라는 우려를 버리지 못하고, 위급상황이라는 명목으로 피험자ㆍ백신접종자ㆍ의료행위의 잠재적 피해자에 대한 설명의무는 더욱더 후퇴되는 현상을 보여주고 있다. 저자는 부족한 의료자원의 문제를 극한 상황에서 자신의 생명마저 위협받는 의사 개인의 결정에 맡길 것이 아니라 국가ㆍ사회적 합의에 기초한 엄정한 절차와 실체적 기준을 마련하는 일을 미루지 말아야 하고, 누구에게나 공정하고 이해 가능한 기준을 마련하는 논의의 성숙을 기대하며, 응급상황이라는 이유로 피험자ㆍ접종자피해자의 동의를 얻는 과정의 자기결정권이 후퇴해서는 안됨을 강조하고 있다. 특히 코로나 뉴노멀에 걸맞게 디지털 소외계층에 대해서는 대면으로, 온라인 사용이 가능한 사람들에게는 비대면의 방식으로 백신의 원리, 개발과정, 가능한 부작용, 그에 대한 보상이나 치료 등에 관한 정보를 충분히 제공할 것을 요구하고 있다. COVID-19 Pandemic은 인류에게 준 교훈을 가치 있게 받아들일 수 있도록 이 교훈을 실천적 논의로 현실화하는 노력을 촉구하고 있다.

Abstract

This paper deals with the question of to whom should be allocated medical resources, if a pandemic such as COVID-19 occurs. It also deals with, whether criminal and civil immunity of the physician or medical personnel is possible who make decisions on the allocation of treatment resources. It examines also the characteristics and problems that appeared in vaccine development and clinical trials. This paper also examines the need for consent of subjects in clinical trials and subjects to be vaccinated for vaccine development, as well as the content and procedure of information provided. In particular, it must be emphasized that, under the pretext of an emergency, the duty to explain clinical trial applicants, vaccine recipients, and potential victims of medical practice is showing a downward trend. To sum up, this article analyzes as follow; most countries are avoiding discussing to whom should be allocated medical resources when faced with shortage of medical resources in exceptional circumstances such as the COVID-19 pandemic. And the state leaves the final choice of the priority of treatment to medical personnel and medical facilities. Politicians try to avoid discussing the topic of medical immunity, because it would cause unnecessary debate and suspicion of bias. The author proposes that we should not leave triage decision on the doctors, who are threatened with their own lives in extreme situations, that we must prepare strict procedures and substantive standards based on national and social consensus. It is emphasized that the right to self-determination in the process of obtaining the consent of the volunteers for clinical trial or person waitung for vaccination should not be withdrawn. Above all, this article emphasizes, we are urging efforts to accept the lessons that the COVID-19 Pandemic has given humans and turn those lessons into practical discussions
