Abstract

Half of the world's refugees are children, and the number of unaccompanied children is increasing. Recognizing that unaccompanied children are most vulnerable and face particular risk of persecution, it has been agreed among the State Parties to the Refugee Convention that children have independent legal standing as refugee petitioners in refugee proceedings and calls for comprehensive and child-friendly refugee determinant consideration. As a refugee petitioner, an unaccompanied child has the burden of meeting the standard of the requirement of 'well-founded fear,' according to the Refugee Convention. The 'well-founded fear' requirement has traditionally been employing the dual approach in proving the case by objective risk and subjective apprehension tests. This article makes a case that the subjective testimonies of unaccompanied children seeking asylum should be mitigated or waived due to a child’s lack of capacity. The article introduces the child-centered perspective needed in evaluating the completeness and consistency of testimonies. The child-centered perspective utilizes and prioritizes the 'best interests of the child' principle of the UN Convention on the Rights of the Child in demonstrating the 'well-founded fear' requirement in the Convention. Accordingly, if the testimony of an unaccompanied child is inconsistent or incoherent, proof of the requirement of 'well-founded fear' should reflect the principle of 'benefit of the doubt’ on behalf of the child’s petitioner in compliance with the UNHCR Handbook. In general, the responsibility and duty to collect material information regarding well-founded fear requirements is co-shared share with the examiner and the refugee applicant. In the case of an unaccompanied child applicant, the examiner bears the further burden to ascertain relevant objective facts regarding the clear risk to the unaccompanied child. Since unaccompanied children may lack sufficient knowledge regarding persecution in their country of origin, the examiner needs to obtain available up-to-date information on the unaccompanied child's country of origin. The maturity, emotional and cognitive abilities, psychological state, and individual circumstances must also be taken into account in determining the validity of the claim of “well-founded fear“. In short, the child-centered approach in proving the “well-founded fear” requirement would further ensure unaccompanied children refugee applicants realize international legal protection rights following the Humanitarian principle and the Refugee Convention
