ICT 기반사회에서 개인정보 보호의 당면과제 -개인정보보호법제 일원화 방안 모색-

이 논문은 ICT 기반사회에서 개인정보 보호의 중요성이 증대하고 있음에도 국내 개인정보 보호 법제는 입법체계간의 정합성을 확보하지 못해 발생하는 문제를 다루고 있다. 이에 따라 본 논문에서는 국내 개인정보 보호법제의 대표법인 “개인정보보호법”,“정보통신망법”, “신용정보법”그리고 “위치정보법”을 실증적으로 분석하였다. 연구결과 “개인정보보호법”과 “정보통신망법”은 2011년 이후부터 중복조항의 문제가 발생하였다. 그리하여 수범자는 물론이고 법 집행기관도 관련 법 적용에 많은 애로사항을 가지고 있었다. 그리고 입법체계정당성을 일탈한 다수의 조항을 발견할 수 있었다. 이러한 문제는 국내 개인정보 보호 법제의 비체계성, 중복성, 중복규제, 불일치의 문제가 있음을 의미한다. 이에 따라 이 논문에서는 ICT 기반사회에서 개인정보 보호를 위한 당면과제로 개인정보보호 법제의 일원화를 제언을 하였다.
Abstract
This paper, the domestic personal information protection legislation even though the importance of protecting personal information in the ICT-based society is increasing, are dealing with issues that arise can not be ensured consistency between the legislative system. As a result, in this paper, it was critically analyze the representative method in the field of domestic personal information protection. “Personal Information Protection Act”, “Act on Promotion of Information and Communications Network Utilization and Information Protection, ETC(Information communication network Law)”, “Credit Information Use and Protection Act(Credit information law)” and “Act on the Protection, Use, ETC. of Location Information (Position information law)”. Research results “Personal Information Protection Act” and the “information communication network Law”, of the overlapping provisions problem has occurred after 2011. Then, it is possible to find many legislative examples that depart the validity of the system for each clause. These problems meas that there is a unstructured, redundancy, regulation and mismatch of domestic personal information protection legislation. As a result, in this paper, as the immediate task for the protection of personal information in the ICT-based society, and proposed the unification of the personal information protection legislation.
