이 글은 윤석열 행정부를 검찰의 기소를 의미하는 ‘Prosecute’와 통치 체제를 표현하는 ‘Cracy’를 조합해 ‘검찰 통치(Prosecracy)’라 규정한다. 원래 윤석열 대통령은 후보 시절 법과 규범의 자유주의 국내외 정치 질서(liberal domestic and international order) 표방과 소통의 정치 복원을 공약하였다. 하지만 초기에 일부정치적 소통의 시도가 나타났을 뿐 지금까지는 전반적으로 이 헌정주의 목표는 반대당을 경쟁자로 간주하기보다는 기득권 카르텔이나 적으로 규정하고 본인을 이를 척결하는 소명을 가진 국민의 대변자로 자청하는 포퓰리즘적 담론과 긴장을 일으킨다. 이에 필자는 이 검찰 통치를 아라토와 코헨(Arato, & Cohen, 2022)의개념을 활용하여 ‘포퓰리스트 헌정주의’ 통치(rule by populist constitutionalism) 의 특징을 가진 것으로서 ‘법과 질서론’ 등 그 구현되는 양상들을 분석한다.
Abstract
This article characterizes the Yoon administration as a "prosecutorial rule" (Prosecracy), a combination of "Prosecute" meaning prosecution and "Cracy" meaning a system of governance. As a candidate, Yoon originally pledged to promote a liberal domestic and international order of laws and norms and to restore the politics of communication. However, while there have been some early attempts at political communication, overall, this constitutionalist goal has been in tension with a populist discourse that characterizes opposition parties as vested cartels or enemies rather than as competitors, and presents itself as a spokesperson for the people with a mandate to eliminate them. I employ Arato & Cohen's (2022) conceptualization of populist constitutionalism to analyze its manifestations such as ‘law and order’ and ‘crime and punishment’ discourses.
