Abstract
This article aims to examine international regimes of patentability on germline gene editing and its implications on Korean perspective. In this article, the research results show that specified principles of public ordre for patentabiliy by Korean Patent Office need more reasonal improvement at this period of highly estimated clinical feasibility of gene editing technology. Basic concept to inherit the existing Bioethics and Safety Act and legal consensus is that patentability of human embryo is limited to unnatural embryos like parthenotes, excluding them in the concepts of existing concepts of embryos. Another framework would be to distinguish the steps from gene editing researches to normal embryos as therapeutic research, to define it as a kind of clinical practice, and to develop regulatory framework in the certain level. With this assumptions, the principles of public ordre have limitations to apply gene editing technology, we need to consider new specifications. However, it should be needed to social consensus as well as science community. In order to use human genome researches to eradicate diseases as the long-standing problems for human being, we need to concern the methods to utilize the public values in the intellectual property system. Future directions of human genome technologies can bring breakthroughs to humankind. Therefore, it is necessary to establish social consensus through accepting the value of human survival and sustainability of traditions, customs, cooperations and solidarity of our society with acceptance the sound governance for human genome researches.
