Abstract

This paper examines the Presbyterian Church Constitution law from the perspectives of victims and gender, and seeks to explore a gender-sensitive church legal framework by proposing measures to protect the human rights of women who are victims of sexual violence in church trials. The study is grounded in the observation that, while contemporary society has been progressively refining legal systems to better protect victims’ rights through gender-sensitive approaches, the current Presbyterian Church Constitutions (Hapdong, Tonghap, and Gijang) have focused predominantly on preserving the authority of a male-dominated permanent leadership, thereby failing to adequately address gender-based violence crime and critically lacking in consideration of victims' rights and gender sensitivity. Chapter 2 examines the legislative measures and systems in the current criminal law that ensure the protection of the human rights of sexual violence victims, as well as the key issues in gender legal studies related to sexual violence crimes. Chapter 3 introduces the concepts and significance of a victim-centered perspective and a gender perspective, and proceeds to critically assess the limitations of the disciplinary provisions within the Presbyterian Church Constitutions. Chapter 4 highlights the prevalence and severity of secondary victimization experienced by victim within church trials and systematically categorizes the types, elements, and applicable sanctions of sexual violence offenses committed in the church from a gender-sensitive standpoint. This paper concludes that establishing a gender-sensitive ecclesiastical legal system is essential for restoring trust within the church community and for ensuring that the rights of victims are fully respected and protected. To this end, the paper proposes the following reforms: First, it calls for the explicit inclusion of sexual violence offenses under the category of crimes subject to disciplinary action. Secondly, it recommends the clear definition of the elements of sexual violence offenses, particularly the violation of sexual self-determination and the exercise of coercion, and the classification of offenses such as rape, quasi-rape, sexual intercourse and molestation involving gender-based power dynamics, sexual offenses against children and adolescents, and digital sexual crimes including illegal filming, deep-fakes, and offenses associated with online chats and mobile messaging, along with corresponding punishment standards. Thirdly, it suggests the establishment of protective provisions guaranteeing the personal safety of victims, immediate separation from perpetrators, the right to legal representation, the recognition of victims’ statements as valid evidence, the prohibition of disclosing personal information, the right to claim damages, and the right to request the disqualification of judges. Fourthly, it emphasizes the need to implement regulations to prevent secondary victimization during the investigation and trial processes. Fifthly, it recommends excluding individuals with personal or institutional ties to perpetrators from serving as members of investigative committees or as judges, and mandating the inclusion of at least two external experts in gender law, ensuring a balanced gender composition in which no gender exceeds 60% representation.
