지금까지 「헌법」은 젠더폭력을 개별 기본권에서 다루지 않았다. 젠더폭력으로부터 자유로울 권리는 신체를 훼손당하지 않을 권리 등을 통하여 보호되는 것으로 볼 수 있지만, 다른 폭력과 구분된 젠더폭력에 대한 국가의 조치를 요구하는 것은 젠더폭력이 성차별과 깊이 연관되어 있 기 때문이다. 젠더폭력으로부터 자유로울 권리는 평등권으로서의 성격이 강조되어야 한다. 이 논문은 젠더폭력의 근절을 요청한 국제인권규범의 내용을 살펴보고, 우리 「헌법」에서 젠더폭력 으로부터 자유로울 권리를 도출할 가능성과 한계를 분석한 다음, 외국 「헌법」에서 젠더폭력으 로부터 자유로울 권리 및 국가의 의무 조항을 둔 입법례를 검토하여, 젠더폭력으로부터 자유로 울 권리의 기본권화 방안을 모색하였다. 향후 개헌에서 젠더폭력으로부터 자유로울 권리는 ‘권 리’로서 기본권성을 명확히 하고, 평등권의 일환으로 자리매김할 것이 요청된다.
Abstract
So far, the Constitution has not dealt with gender-based violence as an individual fundamental right. The right to be free from gender-based violence can be seen as being protected under the right to bodily integrity, but the demand for state action against gender-based violence as separate from other violence is rooted in the argument that gender-based violence is strongly related to gender discrimination. If so, the right to be free from gender-based violence should be emphasized by its character as an equal right. This paper examines the contents of international human rights laws that request the eradication of gender-based violence, as well as cases in which foreign constitutional law states the rights to be free from gender-based violence and the mandatory responsibility of the state to implement them, to explore ways of installing rights to be free from gender-based violence as a fundamental right. It is requested that in future constitutional amendments, the right to be free from gender-based violence is ensured as a fundamental ‘right’, and established as part of equal rights.
