미국의 주(州) 및 지방정부 계약법제에 대한 연구 현재 지방자치단체가 체결하는 공공조달계약(이하 지방계약)에 대해서는 「지방자치단체를 당사자로 하는 계약에 관한 법률」(이하 지방계약법)이 기본법으로서 역할을 하고 있다. 그런데 국가가 체결하는 공공조달계약에 대한 기본법인 「국가를 당사자로 하는 계약에 관한 법률」(이하 국가계약법)과 상당부분 같은 내용을 담고 있어서 독립적인 법률로서 존재하는 것이 바람직한지에 대해서 문제가 제기되고 있는 상태이다. 이러한 문제점을 해결하기 위해서는 비교법적으로 양자의 관계를 어떻게 설정하고 있는지를 살펴볼 필요가 있다. 이를 위해서 이 글은 미국의 많은 주 또는 지방정부들이 채택하고 있는 미국 변호사협회(ABA) 2000년 모델조달법전(Model Procurement Code)을 중심으로 미국의 지방계약법제를 살펴보았다. 이러한 검토를 통해 미국의 지방계약법제는 연방계약법제와 전반적으로 유사성을 가지고 있으면서도, 1) 계약조직, 2) 계약방식, 3) 계약에 대한 감독, 4) 낙찰기준, 5) 분쟁해결절차, 6) 사회·경제정책적 수단의 측면에서 일정한 차이점을 나타내고 있음을 볼 수 있다. 비록 미국인 연방국가로서 우리나라와 법제상황이 다르기는 하지만 미국의 지방계약법제는 지방자치단체의 특성에 맞는 계약제도를 운영할 수 있도록 노력하고 있다는 점에서, 지방계약법과 국가계약법의 관계가 문제되고 있는 우리나라에 다음과 같이 여러 가지 시사점을 제공해줄 수 있다. 우선 계약조직면에서는 각 지자체별로 중앙조달부서를 둠으로써 조달수행업무가 보다 효율적으로 진행되도록 하는 한편, 지자체가 일정부분 조달정책업무도 수행할 수 있도록 할 필요가 있다. 계약방식의 경우에는 국가계약에 비해서 보다 탄력적인 계약방식이 지자체의 사정에 따라 실시될 수 있는 가능성을 열어두되, 주민소송제도의 활성화 등 계약감독제도의 강화를 통해 투명성 약화의 문제점을 해결하는 것이 필요하다. 낙찰방식과 관련해서는 지방계약법에서 최적가치의 취지를 보다 적극적으로 반영하는 것이 필요하다. WTO 정부조달협정의 양허범위를 면밀하게 검토하여 지자체들이 사회·경제정책적 수단으로 지방계약을 적극적으로 사용할 수 있는 가능성을 열어주는 것이 필요하다. 주제어 지방계약, 국가계약, 미국변호사협회 2000년 주 및 지방정부 모델조달법전, 공공조달, WTO 정부조달협정
Abstract
A Study on the State and Local Government Contract Law in the United States Kim, Dae-In (Professor of Ewha W. University, School of Law) In Korea, “Act on the Contracts in which the Local Government is the Party”(Local Government Contract Act) serves as a basic statute which regulates principles and procedures of public procurement contract by local government. As this statute entails many similar provisions in comparison to “Act on the Contracts in which the State is the Party”(State Government Contract Act), there are disputes whether it is desirable that Local Government Contract Act would exist as a separate statute. To address this issue, it is necessary to see other jurisdiction’s experience. To this ends, this paper looks into United States’ regime focusing on the American Bar Association (ABA)’s Model Procurement Code for State and Local Government in 2000, and then compares with that of Federal Acquisition Regulation (FAR). This comparison shows that there are many distinctions between these two regimes in perspective of 1) contract organization, 2) contract types, 3) contract monitoring, 4) award criteria. 5) dispute resolution, and 6) socio-economic policy aspect of public procurement, despite many similarities as well. Although Unites States as a federal government system, differs from Korea as a unitary government system, Unites States’ state and local government contract law gives following implications to Korea who are struggling to solve relationship problem between Local Government Contract Act and State Government Act. First, it is necessary to launch centralized procurement unit in each local government to enhance efficiency of procurement and make room for each local government to establish procurement policies of its own. Second, it is desirable to allow more flexible type of procurement contract be used by each local government, however, strengthening control system such as local citizen’s lawsuit (qui tam action) should be complemented. Third, best value approach in award criteria should be more actively implemented. Fourth, more active use of public procurement as a tool for socio-economic policy should be executed with due consideration of the WTO Government Procurement Agreement.
