국가와 지방자치단체간 및 지방자치단체 상호간 협약제도 고찰

최근에 국가와 지방자치단체간 협력 및 지방자치단체 상호간의 협력을 활성화하기 위해서 ‘협약’의 중요성이 높아지고 있는데, 2024년 5월 21일 입법예고된 「지방자치법」 개정안에도 국가와 지방자치단체간 및 지방자치단체 상호간의 협약제도에 대한 내용이 포함되어 있다. 이 글에서는 해외(영국과 미국)의 지방자치단체 협약제도와의 비교연구를 토대로 우리나라 지방자치단체 협약제도의 발전방안을 제시하고자 하였다. 우리나라 지방계약제도의 발전방안은 다음과 같다. 첫째, 법적 성질의 면에서 보면 협약을 체결하는 지방자치단체간에 법적 의무를 발생시키고자 하는 의사가 있는지, 의무의 내용이 어느 정도 구체적인지, 분쟁해결과 관련하여 어떤 규정을 두고 있는지 등을 종합적으로 고려하여 계약으로 볼 수 있는 경우에는 ‘공법상 계약’으로서의 성격이 인정되는 것으로 보아야 할 것이다. 「지방자치법」 개정안에 들어가는 협약은 공법상 계약으로서의 성격이 분명해지도록 관련규정을 둘 필요가 있다. 둘째, 법적 근거의 면에서 보면 지방자치단체간 협약이 지방자치단체간 권한의 분배, 의무의 부과에 관한 사항을 담고 주민에게 미치는 영향도 크다는 점에서 「지방자치법」에 지방자치단체가 체결하는 협약의 근거를 명시적으로 두는 것이 필요하다. 다만 개별 법률에서도 협약에 관한 규정을 두고 있기 때문에 개별 법률의 협약규정과 「지방자치법」의 협약규정의 관계가 보다 명확하게 규율될 필요가 있다. 셋째, 절차면에서 보면 지방의회에 의한 통제, 정보공개 등 지방자치단체간 협약을 절차법적으로 규율하는 내용 및 협약체결 이후의 사후관리를 위한 내용이 「지방자치법」에 들어가는 것이 필요하다. 넷째, 분쟁해결의 면에 있어서는 이미 「지방자치법」에 있는 행정형 ADR제도의 활용이 가능하다고 할 것이나, 공법상 계약에 따른 의무의 이행이나 확인에는 공법상 당사자소송이 장점이 있으므로 이 소송형식이 적극적으로 활용되도록 할 필요가 있다. 이를 위해서는 당사자들이 행정형 ADR와 당사자소송간에 선택이 가능하도록 해야 한다.
Abstract
In recent years, the importance of ‘agreements has been increasing in order to strengthen cooperation between the state and local governments and cooperation among local governments, and the proposed amendment to the ‘Local Autonomy Act’ on May 21, 2024, includes clauses on agreements between the state and local governments and among local governments. This article proposes improvements of Korea’s local government’s agreement system based on a comparative study of US and UK local government’s agreement systems. Following improvements are required to local government’s agreement system in Korea. First, in terms of the legal nature of the agreement, it should be recognized as a ‘public law contract’ if it is recognized as a contract by comprehensively considering whether there is an intention to create legal obligations between parties entering into the agreement, how specific the obligations are, and what provisions are made for dispute resolution. It is necessary to make relevant provisions to clarify the nature of agreements in the proposed amendments to the ‘Local Autonomy Act’. Second, in terms of the legal basis, it is necessary to explicitly establish the basis for local government’s agreements in the ‘Local Autonomy Act’, as local government’s agreements contain matters related to the distribution of authority and imposition of obligations between parties and have a significant impact on residents. However, since individual laws also have provisions on agreements, the relationship between the agreement provisions of individual laws and the agreement provisions of the ‘Local Autonomy Act’ needs to be more clearly regulated. Third, in terms of procedures, the ‘Local Autonomy Act’ should include procedural laws governing interlocal agreements, such as control by local councils and disclosure of information, as well as contents for follow-up after the agreement is signed. Fourth, in terms of dispute resolution, the administrative ADR system which already exists in the ‘Local Autonomy Act’ can be utilized, but it is necessary to actively utilize party litigation under public law has the advantage in fulfilling or confirming obligations under contracts in public law. For this purpose, it is necessary not to operate the administrative ADR system as a mandatory precursor to party litigation.
