행정의 복잡성 및 광역행정의 필요성이 높아지면서 지방자치단체간의 협력을 필요로 하는 경우들이 늘어나고 있고, 이 과정에서 ‘지방자치단체간 협약제도’의 중요성이 높아지고 있는 상황이다. 이러한 점을 고려하여 이 글에서는 독일과 일본의 지방자치단체간 협약제도를 검토하고 이를 토대로 우리나라 법제의 발전방안을 모색해보았다. 이를 정리해보면 다음과 같다. 첫째, 법적 성질면에서 보면 독일은 지방자치단체간 협약에 대해서 공법상 계약으로서의 성격을 인정하는 것이 일반적이며, 일본은 법적인 의무의 구체성 정도 등을 고려하여 계약여부를 판단하고 있다. 또한 독일과 일본 모두 지방자치단체간 협약에 대해서 법률상 근거를 두고 있다. 우리나라에서도 지방자치단체간 협약은 이것이 권한의 분배, 의무의 부과에 관한 사항을 담는다는 점에서 지방자치법에 개별적인 법률상 근거를 두는 것이 필요하다. 둘째, 절차면에서 보면 독일에서는 주법에서 지방의회의 승인 등 절차에 관한 규정을 두고 있고, 일본에서도 지방자치법에서 역시 연계협약내용의 고시, 지방의회의 동의 등 절차적인 통제가 이루어지고 있다. 그러나 우리나라의 경우 지방자치법에 의한 절차적인 통제도 명시적으로 이루어지지 못하고 있다. 지방의회에 의한 통제, 협약내용의 공개 등 지방자치단체간 협약을 절차법적으로 규율하는 내용이 지방자치법에 들어가는 것이 필요하다. 셋째, 분쟁해결면에서 보면 독일에서는 지방자치단체간 협약에 대해서 법원을 통한 해결제도가 주로 활용되고 있으며, 일본에서는 지방자치법상의 연계협약에 대해서 행정형 대체적 분쟁해결제도(Alternative Dispute Resolution: ADR)제도가 마련되어 있다. 우리나라의 경우 기존에 존재하는 행정형 ADR 제도도 활용될 수 있지만, 공법상 계약에 따른 의무의 이행이나 확인에는 공법상 당사자소송이 장점이 있으므로 이 소송형식이 적극적으로 활용되도록 할 필요가 있다.
Abstract
The need for cooperation between local governments is increasing because of complexities and needs for wide-area public administration. In this context, the importance of cooperative agreement between local governments is emphasized. Considering this phenomenon, this paper deals with the Korean cooperative agreements in comparison with those of Germany and Japan. From this analysis, following implications can be found. First, in relation to legal nature, theses cooperative agreements are normally considered as public contracts in Germany, while the level of obligation’ concreteness decides the contractual nature of these agreements in Japan. And there are statutory ground for cooperative agreements in both countries. Korea also needs statutory ground in ‘Local Autonomy Act’ for cooperative agreements as these entail distribution of power and imposition of obligation. Second, in relation to procedure, Germany and Japan provides procedure for these agreements such as approval of local counsel, and disclosure of these agreements. However, Korea does not provide such procedures on these agreements. It is necessary to include procedural clauses in ‘Local Autonomy Act’ such as the control of local counsel or information disclosure. Third, in relation to dispute resolution, dispute resolution through litigation in court is usually used in Germany, while Japan provides administrative Alternative Dispute Resolution (ADR). In Korea, party-litigation in public law should be actively implement to address disputes in these agreements with contractual nature.
