지방자치단체의 토지이용의 중요성에 비추어 볼 때, 지방자치단체의 토지이용권의 강화를 위한 제도적 개선의 필요성은 자명한바, 지방자치권의 강화문제에 관하여 종래의 논의는 지방자치제도 자체의 측면에서만 접근하여 왔으나, 실제적으로 지방자치제도는 - 제도적 보장의 성격상 - 국가법제에 의한 영향력이 클 수밖에 없으며, 이는 지방자치단체의 토지이용에 있어서도 마찬가지이다. 본고는 지방자치단체의 토지이용권의 강화라는 관점에서 종래 논의들이 중심적인 문제로 접근하였던 소위 계획고권 자체의 문제가 아니라, 지방자치단체에게 보장된 계획고권을 전제로 우리나라 현행 지역개발법제에 대한 문제점 및 그 개선방안을 시론적으로 모색하려는 것이다. 토지행정의 입법적 요소부터 계획적 요소, 구체적 처분적 요소까지 포함된 종합적 행정인 점에서 토지행정에 있어 지방자치권의 강화는, 지방자치단체에 대한 단순한 사무 및 권한의 배분을 넘어 그 결과물로서 효율적 토지이용을 통한 재정자립도의 확대에까지 기여할 수 있는 중요한 영역이라 할 것이며, 그러한 점에서 지방자치단체의 토지이용권의 강화를 위한 지역개발법제의 개선 노력은 필요한 동시에 중요하다 할 것이다. 그 구체적인 내용적 측면에 대해서는 보다 심도있는 연구가 계속되어야 할 것이지만, 적어도 지역개발통합법 체계의 도입은 지역개발 관련법제의 체계적 정비와 더불어 입법기술상의 경제성에도 기여할 수 있음은 물론, 우리나라 토지이용 및 지역개발 법제의 현실적 문제해결과 더불어 국가와 지방간의 적절한 협력과 조화를 통한 전 국토의 효율적이고 균형있는 개발을 가능케 하는 바람직한 대안이 될 수 있을 것이다.
Abstract
When we consider the importance of land use, it is obvious that improving the system to strengthen the Local government's right of land use is necessary. Former studies have approached enhancing the Local government's right in the local autonomy aspect, but actually the local government's land use is influenced by the national law system, just as the local autonomy. Therefore this research is going to discuss problems and improvement plans about our current Regional development acts premised on Local government's plan sovereignty. Strengthening the Local government's right of land use, as a comprehensive administration including legislative factor, intentional factor, concrete factor, can be a important province that can contribute to extension Local government's power in the financial side by using land effectively. In this point, efforts to improve Regional development acts gain in importance at the same time. Although there must be a continuous and substantial research, introducing 'Regional development united act' will systematize regional development acts and make for economical legislative technique. Also, it will solve practical problems of land use and regional development and make effective and balanced development of national land possible through appropriate cooperation and concordance between the Government and the Local government.
