배제와 폭력에 대한 대항으로서의 심의 민주주의의 가능성- 벤하비브(S. Benhabib)의 ‘심의 민주주의’를 중심으로

이 글은 근대 주권국가내에서, 그리고 전반적인 민주주의의 위기 속에서, 인간으로서의 존재가 가지고 있는 내용, 역사성, 존엄성 등이 빠져버리고 아감벤이 제기한 ‘텅 빈 생명’ 그 자체로만 환원됨으로써 배제와 폭력을 경험할지도 모르는 공포 속에 우리의 삶이 놓여있게 된 문제에 어떻게 접근해야할 것인가라는 문제의식에서 출발한다. 이 글에서는 이러한 문제에 접근하기 위해 ‘평등, 치자와 피치자의 동일시, 그리고 인민 주권 등의 사상으로 구성되는 민주주의의 전통’으로 되돌아가 논의하는 것이 필요하다고 보고, 배제가 없는 합의의 가능성을 상정하고 있는 심의 민주주의 모델, 그 중에서도 벤하비브의 심의 민주주의 논의가 가지고 있는 가능성을 살펴보았다. 그 결과 벤하비브의 심의 민주주의 모델은 근본적으로 다원적이고 이질적인 가치들과 이해관계들의 갈등에 주목한다는 점, 사회운동에 이르기까지 심의의 구조를 확장하고 있다는 점, 익명의 공적대화를 보장할 수 있는 매개모델을 지적하고 있다는 점, 열린 ‘합의’의 개념을 제시하고 있다는 점, 존재들을 연결할 소통적 심의에 기반하고 있는 점 등에서 이러한 문제들에 접근할 가능성을 가지고 있다고 보았다. 끝으로 이 글은 오랫동안 사적 영역에 유폐되어왔던 여성들은 우리 사회가 허용하는 공적 영역에서 아감벤이 이야기한 ‘텅 빈 생명’으로 환원될 가능성을 담지하고 있는 존재라는 점에서 아감벤과 벤하비브의 논의는 여성주의에 중요한 함의를 줄 수 있을 것이라 보며, 이후 이에 대한 활발한 논의의 필요성을 제기하고자 하는 시도이다.
Abstract
Today, our lives are besieged with fear that we may go through exclusion and violence by reducing to ‘bare life’(Giorgio Agamben suggested this in Homo Sacer(1998)) in the sovereign state and the whole crisis of democracy. How can we approach this problem? This article starts this question. I think that it is necessary to return to the tradition of democracy that is comprised of equality, identifying the ruler with the ruled, and the ideal of popular sovereignty and start our discussion about it in order to approach this problem. So I examined closely the possibility of Seyla Benhabib’s model of deliberative democracy that supposed the possibility of mutual consent without a exclusion. As a result, I suggested that her model of democracy had several possibilities; focusing on fundamentally plural and heterogeneous value and conflict of interests, extending the structure of deliberation to the social movement, pointing out the model of intermediation that can ensure the public communication of anonymity, suggesting the notion of the open concurrence, and being based on the communicative deliberation to connect human beings. Finally, I think that women, having been situated in the private realm for a long time, have much more possibilities reducing to ‘bare life’in the public realm, so the argument of Agamben and Benhabib can give some significance to feminism. This article is an attempt to suggest the necessity of active debates about it.
