무형유산을 둘러싼 용어의 경합 I - 전승공동체와 커뮤니티의 다름에 대한 일 고찰

최근 우리나라의 무형문화재를 포함하는 문화유산 보전정책에서는 유네스코 협약의 패러다임으로 전환하려는 목표를 가지고 법과 제도 바꾸고 있다. 본고에서는 이러한 무형유산 제도의 전환을 둘러싸고 일어나는 용어의 교섭과 경합에 대해서 살펴보았다. 협약의 공동체와 국내 ‘전승공동체’ 의 법률적·행정적 용어의 개념은 서로 다른 뿌리에서 출발한 용어이다. 따라서 우리나라가 협약의 패러다임으로 전환하는 과정에서 일어나는 문화번역의 문제가 복합적이고 모호하지 않을 수 없다. 이 점을 인식하면서 전승공동체가 가지는 개념, 범위 및 관련 보전 정책의 문제를 분석한다. 보유자와 보유단체 지정이 어려운 종목을 전승공동체라는 제 3의 범주를 만들어서 지정하게 되면서 일어나는 문제는 향후 더 복잡한 문제를 야기할 수 있다. 마을공동체적 삶의 양식에 기반을 두고 무형문화재로 선정된 종목 가운데는 아직도 살아 움직이는 공동체의 참여, 역할, 공유의식 등이 존재하는데, 이들이 소외되어 있음도 지적하였다. 새롭게 등장한 전승공동체 보전 정책이 기존의 무형문화재 보전 정책에 더하여져서 이중구조가 만들어지고 있기 때문이다. 이는 국제사회의 기준과 정합성을 높여야 한다는 방향과는 달리 공동체성은 더 모호해지고 복잡해지고 있음을 의미한다. 본고에서는 개인과 단체가 속한 무형유산 공동체를 보전하고 활성화하는 방안이 국제적인 무형유산의 보전방향과 궤를 같이 한다는 점을 밝히고 있다.
Abstract
In recent times, Korea's policy regarding the protection of cultural heritage, encompassing intangible heritage, is undergoing legislative and systemic alterations aimed at aligning with the principles delineated in the UNESCO Convention. Within this context, this study examines the discourse, negotiation, and terminological evolution surrounding the transition of the intangible heritage framework. Notably, terms such as "legal and administrative terms of the community of the Convention" and the indigenous concept of the "transmission community" stem from disparate origins, engendering complexities and ambiguities in the cultural translation process accompanying Korea's shift towards the convention paradigm. Acknowledging this fundamental distinction, I undertake an analysis of the conceptual underpinnings, ambit, and concomitant policy concerns pertaining to the transmission community. The delineation of a third category, denoted as the transmission community, to designate elements for which identification of holders and holding groups poses challenges, presents potential complexities in the future. Despite the continued presence of intangible cultural properties rooted in communal lifestyles, participatory dynamics, roles, and communal consciousness, certain segments of the populace find themselves marginalized within this evolving framework. The introduction of the transmission community protection policy, supplementing the existing regime for safeguarding intangible cultural heritage, engenders a bifurcated structure. This dualistic arrangement, rather than fostering greater alignment with international standards promulgated by the ICH community, exacerbates the nebulous and intricate nature of community delineations. Consequently, this paper underscores the imperative of preserving and revitalizing intangible heritage communities, to which both individuals and groups are intrinsic, in consonance with the overarching ethos of UNESCO's intangible cultural heritage safeguarding objectives.
