Abstract

Recently designed supply chain restructuring policies involve specific policy measures, including tools for industrial policies, that seem to conflict with the existing WTO rules. However, these measures are often claimed to be justified on the grounds of national security. The WTO panel jurisprudence on the dispute regarding US Section 232 measures on certain steel and aluminum products provides insights to whether such measures applied for supply chain restructuring policies, based on national security reasons, could or should be defended through the WTO security exception clauses. This study first examines the development of US supply chain restructuring policies backed by national security interests and attempts to understand how US Section 232 measures have been utilized within such policy context. Next, it analyzes the WTO panel report regarding the dispute on US Section 232 measures and highlights legal issues and challenges to the world trading system posed by increasing ‘securit-ization’ of supply chain restructuring policies due to intensifying geo-economic tensions. Against this backdrop, the study reviews recent academic debates on how the WTO system should adapt to the new reality, especially by revising the existing security exception clauses. The study emphasizes a structural approach in revising the security exception provisions in tandem with an ultimate reform of the rules to effectively govern non-market economies in the world trading system. Meanwhile, the study also emphasizes the criticality of temporal efforts for Members to explore creative ways to enhance institutional flexibility of the multilateral trading system, in order to maintain at least the minimum of its relevance with ongoing economic security debates in non-WTO fora.
