Reconciling Digital Trade, National Security, and WTO Norms

Abstract

This paper examines the intricate relationship between digital trade rules and national security. The expanding concept of security, driven by the rapid evolution of digital technologies, has significantly impacted the traditional national security exception in international trade law. To address this challenge, it analyzes existing WTO, GATT and GATS legal frameworks and international standards related to digital security by clarifying essential security interests, institutionalizing the national security exception, and adopting a dynamic approach to interpreting general exceptions. To mitigate national security risks in the digital trade, it emphasizes the importance of developing resilient cybersecurity infrastructures, enhancing cross-border cooperation, and implementing advanced threat detection and response mechanisms. The research also underscores the critical role of public-private partnerships in strengthening national digital defenses. Maintaining digital security is an ongoing process that requires constant vigilance, innovation, and collaboration among all stakeholders to effectively combat evolving cyber threats.
