경제안보를 위한 산업기술 법률 프레임워크에 관한 연구

기술패권 경쟁으로 경제안보가 국가적 의제가 되면서 각 부처들은 산업기술 보호와 육성에 관한 여러 정책을 제시하고 법률을 제·개정하고 있다. 관련 법들은 서로 다른 목적으로 마련되었으나 국가적으로 중요한 기술을 ‘산업기술’, ‘국가핵심기술’, ‘국가첨단전략기술’, ‘국가전략기술’ 등 유사하거나 동일한 용어로 정의하고 있으며, 이를 기반으로 다양한 정책이 수립되고 있다. 한편, 기술주권을 강화하기 위한 국가별 전략 마련이 시급한 상황에서 국내에서 여러 법과 정책들이 산발적으로 추진됨에 따라, 정부와 전문기관의 역량 분산, 예산의 비효율적 집행, 정책 결정및 추진절차의 지연 등이 우려된다. 또한, 현장에서는 피규제자들이 법·정책을 예측하거나 해석하기 어렵고 중복규제, 이해관계 상충 등의 문제를 겪을 수 있다. 따라서, 보다 거시적인 관점에서 입법체계를 정비할 필요가 있다. 본 연구는 국제사회에서 논의되는 산업기술 보호·육성·협력의 균형성과 정책의 정합성 등의개념을 바탕으로 산업기술 입법체계의 기본방향을 설정하였다. 또한, 산업기술 법·정책 관련 선행연구와 주요 법률에 대한 입법적 논의를 종합적으로 수집하여 산업기술 입법체계에 포함하여야할 핵심적 요소를 설계하고 고려사항을 정리하였다. 이를 바탕으로 산업기술 법률 프레임워크를제시하였고 산업기술의 보호와 육성에 관한 12개 법률에 적용하여 세부 규정과 체계상의 특징을분석하였다. 구체적인 규정 분석을 위해서는 주요 산업기술 법률 가운데 ‘보호’와 ‘육성(혁신)’에관한 4개 법률에 본 연구에서 설계한 프레임워크를 적용하여 요소별로 분류한 후 정합성을 검토하였다. 마지막으로 본 연구의 내용을 정리하고 현행 산업기술 입법체계의 개선과제를 제시하였다.
Abstract
As economic security emerges as a national priority due to competition for technological hegemony, each ministry is implementing various laws and policies aimed at protecting and fostering industrial technology. Despite the diverse purposes of economic security-related laws, they often define nationally significant technologies in similar or identical terms. While it is imperative for each country to develop a strategy to strengthen technological sovereignty, laws and policies are being established sporadically. Accordingly, Concerns arise regarding the inefficiency of the government's capabilities, budget, and policy implementation. Regulators may struggle to interpret regulations and experience problems such as overlapping regulations and conflicts of interest. Therefore, there is a need to reorganize the legislative system from a broader perspective. This study establishes the legal framework of the industrial technology based on the concepts of balance and policy coherence in the protection, promotion, and Projection of industrial technology as discussed in the international community. Additionally, this study identify key elements that should be included into the legal framework by comprehensively reviewing prior research and legislative issues in major laws. The legal framework was confirmed by applying it to 12 laws on industrial technology. Among the significant industrial technology laws, consistency is evaluated by applying the legal framework to 4 laws concerning 'protection' and 'promotion(innovation)'. Finally, the study summarizes its findings and concludes by suggesting improvement for the current industrial technology legislative system.
