Abstract

This study targets the constitutional revision debate on the form of government that was triggered by the impeachment of the president in 2025. In particular, it examines the applicability of the decentralized presidential system (so-called bicameral system) and Article 67 of the German Basic Law (constructive vote of no confidence). To this end, the research questions were, ‘What should be reviewed for the success of the decentralized presidential system, which is the direction of the 10th constitutional revision?’ and ‘What are the necessary conditions for the constructive vote of no confidence in Germany to stabilize the bicameral system as a decentralized presidential system?’ First, it is stated that the unclear status of the ‘Prime Minister’ under the current Korean constitutional system is a limiting factor in the constitutional revision debate on the decentralized form of government. Second, this study aims to examine the theoretical concepts of the existing presidential system and the dual government system and the principle of separation of powers, which is the essence of the discussion on the form of government, through literature studies from academia and the National Assembly, and to compare and analyze the dual government systems of the Fifth Republic of France and the former Weimar Republic of Germany and the modern Federal Republic of Germany, where the constructive vote of no confidence is applied. Third, despite the fact that the constructive vote of no confidence in the Federal Republic of Germany has the institutional complementary advantage of ‘promoting coalition negotiations’ by preventing the ‘power vacuum’ experienced by the former Weimar Republic, it examines the fact that it cannot avoid future conflicts with the majority party in the National Assembly (parliament) due to differences in political culture, constitutional system, and political structure in Korea, which is operating under the 1987 constitutional system. Lastly, we will clarify the ‘planned background’ that the National Assembly’s no-confidence vote and successor prime minister election system that can occur under a decentralized presidential system, that is, a bicameral system, can only amplify the instability of the constitutional system, and suggest additional institutional and procedural supplementary measures that must be reviewed along with the introduction of a constructive no-confidence vote to supplement this. The results of this study show that even if the German-style constructive no-confidence vote is introduced to the Korean government system along with the decentralized bicameral system, there is a constant possibility that the stability and efficiency of state affairs will be hindered due to the possibility of additional and continuous axes of proxy conflict between the prime minister and the president, and further between the ruling and opposition parties, in the parliamentary structure of the ‘split government phenomenon’ in Korea. Accordingly, we conclude that the 10th constitutional amendment, that is, the constitutional amendment to a decentralized presidential system, requires not simply the transplantation of the system, but a customized design that reflects the characteristics of the political culture and constitutional system in Korea.
