Abstract
Offshore wind power is emerging as a critical strategy for enhancing energy security and achieving carbon neutrality in the era of energy transition. However, the existing permitting system for offshore wind power projects has faced considerable criticism due to several limitations: individual developer site selection, fragmented and inefficient permitting procedures under various separate laws, significant stakeholder conflicts, and low business predictability. A particular procedural flaw exacerbating uncertainty is the post-licensing assessment of site suitability from environmental and security perspectives, even after an initial generation business license has been issued. To address these issues, the Special Act on the Promotion of Offshore Wind Power Development and Industry Nurturing, enacted in March 2025, fundamentally restructured the permitting paradigm for offshore wind projects. The Act's core features include a state-led planned siting system, a competitive bidding process for developer selection within designated sites, and an integrated permitting review procedure. These changes aim to systematically manage marine space, select optimal developers in the public interest, and enhance project development speed and predictability through a unified permitting system. This paper examines the public law implications of the planned siting regime, the developer selection mechanism, and the revised project development procedures introduced by the Special Act. It analyzes key legal issues, including the legitimacy of the planned siting system, the scope of restrictions on developers’ rights, administrative discretion in site designation, the legal nature of competitive bidding and safeguards for its procedural legitimacy, and the legal status and treatment of existing developers following the legal transition. Drawing on the German Federal Constitutional Court’s recent ruling on a constitutional complaint regarding Germany’s offshore wind power legislation, the paper explores the extent to which existing developers' rights are protected and discusses implications for the formulation of subordinate legislation. In conclusion, the Special Act on Offshore Wind Power represents a significant transformation in the legal governance of offshore wind development—from a private-led, reactive regulatory model to a state-led, planning-based and market-oriented framework. By analyzing the legal challenges and implications associated with these structural reforms, this paper seeks to contribute to the realization of the Act’s legislative intent and to provide guidance for the effective enactment of subordinate legislation.
