WTO 협정상 투명성 제고를 통한 MRA 체결 전략:AEO MRA 체결요인 실증분석을 중심으로

초록

WTO 무역원활화 협정이 발효되면서 WTO 회원국에 수출입 및 통관과 관련하여 기존보다 더 높은 투명성을 요구하고 있다. 그러나 WTO 협정상 투명성 원칙의 관점에서 AEO MRA 체결을 분석한 선행연구는 부족하였다. 이에 본 연구는 WTO 협정상 투명성이 AEO MRA 체결에 미치는 영향을 패널 프로빗 모형으로 실증분석하여 투명성 제고를 통한 MRA 체결 전략을 논의하였다. 본 연구는 WTO 협정상 투명성의 요소로 정보접근성, 공정한 규정집행, 신속하고 독립적인 사법적 불복절차를 도출하였고, 각 투명성 요소들이 AEO MRA 체결에 유의미한 영향을 미침을 확인하였다. 실증분석결과를 토대로 본 연구는 AEO MRA 체결 촉진 방안으로, AEO 제도에 관한 정보가 부족한 개발도상국을 위해 정보에 쉽게 접근할 수 있는 공식적인 창구를 마련하여야 한다는 점, 소관기관 사이에 정보접근성에 관한 국제협력이 필요하다는 점, AEO MRA가 자의적인 AEO 제도 집행 방지 및 무역장벽 예방을 할 수 있도록 AEO 관련 제도를 단일화하여 해야 한다는 점, 정부의 규제집행에 대한 사법적 불복절차에서 독립성과 공정성을 향상시켜 투명성을 제고하여야 한다는 점을 제시하였다. 본 연구는 투명성 원칙과 비관세장벽인 통관절차에 관하여 실증분석을 실시하여 MRA 체결 전략을 논의한 데 의의가 있다. 본 연구는 연구 결과를 통해 비관세장벽 전반에 걸친 MRA 체결을 촉진하는 데 기여하고자 하였다.

Abstract

On February 22, 2017, the WTO Agreement on Trade Facilitation came into force and the Authorized Economic Operator(AEO) program has a legal base in the WTO Agreement. In the future, the AEO program will be spread, and WTO members need to maximize its trade facilitation effect by signing the AEO MRA more actively. Therefore, this article aimed to suggest a strategy for signing the AEO MRA through enhancing transparency under WTO Agreements, which requires higher transparency to WTO members regarding the import/export process and customs clearance. This article explains the significance of the AEO MRA and the elements of transparency under the GATT and the WTO Trade Facilitation Agreement. Then, this article conducts empirical analysis to estimate the effect of the elements of transparency under the WTO Agreement on the signing of the AEO MRA with the panel probit model. The result of empirical analysis shows appropriate information accessibility, uniformed and impartial regulation administration, and judicial independency promotes the conclusion of AEO MRA. This article suggests several measures to improve transparency for promoting the conclusion of MRAs; actively participating in the information exchange through international cooperation between customs authorities, supporting developing countries so that developing countries can easily access information provided by the official authority, managing regulatory programs by the single authority and rearranging regulations about the programs. In addition, this article emphasizes that transparency can be improved by guaranteeing the independence and fairness of the judicial process against the government’s regulatory enforcement for conclusion of MRAs.
