재난행정법에 관한 독일에서의 논의와 그 시사점

독일에서는 동서갈등과 이와 관련한 이른바 냉전이 끝난 후에는 긴급사태의 경우에 시민을 보호하기 위한 재난행정법은 널리 법정책적 의미와 제도적 인적 실체가 약화되었다. 오늘날 이러한 법영역은 그 배경으로 테러 공격, 새로운 유형의 전염병, 증가하는 대형사고 그리고 종종 지역적으로 제어할 수 없는 위협들이 발생하면서 하나의 르네상스를 체험하고 있다. 한편으로 법질서는 사실 그러한 도전에 대하여 규범적이고 조직적으로 잘 준비해오고 있다. 다른 한편으로 재난 행정법은 최근 단지 선별적으로만 계속 발전해오고 있는 실정이다. 그 때문에 출발할 때의 변경된 조건들이 적절히 고려되고 있는지 의문이다. 본고는 최근의 법적 상황를 보여주고 있고 아울러 재난행정법이 예방, 리스크배려, 협력, 의사소통, 학제성 그리고 국제화라는 전향적 기준을 얼마나 지향하고 있는지 고찰하고 있다. 행정수준과 시민수준 사이에 확인된 정보비대칭은 헌법적으로는 기본권의 보호의무 차원으로 말미암아 문제되고 그리고 행정학적으로는 필요한 재난커뮤니케이션단계의 관점에서 문제로 삼을 수 있다. 이러한 부족한 점은 우선 입법자에 의해 공식화할 수 있는 안전개념을 기본적으로 재정립할 필요성을 일깨운다. 그 발전은 이 시점에 모두 실현할 수 없다. 오히려 단지 주요 결함과 그에 상응하여 포괄적인 재난방지개념의 꼭 필요한 기둥 정도를 언급해야 하지 않을까? 그것은 바로 정보관리의 문제이다. 필요한 것은 연방정부, 주정부 및 지방자치단체 행정의 정보관리를 어떻게 개선할 것인가에 관한 문제의식이다.
Abstract
After the end of the East-West conflict and the related so-called Cold War, the disaster administrative law lost for the protection of civilians in time of emergency largely legal-political importance or institutional and human substance. Currently experience this right area in the context of terrorism, new diseases, increasing major accidents and other often territorial uncontrollable threats a renaissance. On one hand, the legal system is even for such challenges normative and organizational well prepared. On the other hand, the disaster administrative law has only recently selectively developed further. Therefore, it is questionable whether it carries the converted output conditions appropriately. This paper shows the current legal status, and works out How the disaster administrative law is based on the forward-looking criteria prevention, risk prevention, cooperation, communication, interdisciplinarity and internationalization.
