Abstract
People's distrust of the civil justice system has been on the rise in recent years. As one of various solutions to this, direct judicial participation by the public, such as jury systems, has been proposed. To this end, civil jury systems in various countries have been studied, but little has been done in the UK jury system. The reason behind this is the irony that civil juries have almost been abolished in England, the home of the jury system. One can argue that civil jury trials are almost abolished given the fact that the rate of civil jury trial is only about 1% of the total civil cases. However, there is a big difference between the availability of jury trials in civil cases and the impossibility of jury trials as an option for trial. That is the important point about the U.K.‘s civil jury system that I came across while researching the related legislation of the U.K. The use of civil jury is currently limited to three types of cases in which a party may request a jury trial as a right. However, a judge is given a discretion to permit a jury trial in all civil cases as long as a party requests a jury trial. In terms of obtaining the trust from the public, it is an important principle that the justice system not only is just but also appears to be just. Leaving the possibility of judicial participation by the public or excluding it fundamentally makes enormous amount of differences to the appearance of the judicial system that should be viewed as just. In Korea, there is a need to introduce a civil jury system for a limited number of cases that do not significantly impair the efficiency and speed of the entire civil justice system. Since the regaining the public trust in the civil justice system remains a priority, it is necessary to allow juries to decide cases—even if the issues are complicated—that involve a great number of public and their interests.
