Abstract

A core keyword that is consistent throughout the history of the US civil jury trial system may be deemed to be a role which is an important tool for establishing self-governance system of ordinary citizens against the monopoly of judicial jurisdiction as well as an important check device against the risk that a judicial jurisdiction may be abused by the state power. The civil jury trial system has shown its institutional superiority in that it can reflect the concept of social justice held by ordinary people, not professional judges, in the judgment process on the actual substance of dispute. In the background that in the United States, the jury trial has developed more and more being maintained until now, the cause may be found in the fact that the jury’s verdict has traditionally reflected the common value and culture of community adequately, fulfilling the expectation of litigants and general public to a considerable extent, and the fact that in the ability of judgment on factual relations, it has received considerable favorable comments from professional judges as well. Even in the case of litigation involving social disputes or issues which are complex and involve interests of the entire social community, a verdict through a jury can be a more appropriate solution. In particular, when mutual interests among the social groups are in sharp contrast, the jury trial system rendering conclusions through a verdict organized for one-time and disorganized right after may also play a role to protect the judicature from attacks of unilateral public opinion which can be concentrated on professional judges when they assumed the role. In modern society, various types of civil disputes among individuals, groups (corporations) and nations (local autonomous entities) occur, and due to extreme conflicts of interests, many cases that are difficult to find solution only with legal and logical approaches often occur. Therefore, it is necessary to review a plan to introduce the civil judicial system in Korea, even for partial adoption, referring to the above advantages of the civil jury trial in the US. When social conflicts in sharp contrast are filed before a court as the case of litigation, in reference to the experiences of US, it may be a solution to introduce the civil jury trial system even for partial adoption, and entrust the judgment to the jury. In reality, although the introduction of the civil jury trial system is difficult to be carried out due to the lack of constitutional provisions, it is also necessary to review a plan to have the jury perform only the function to settle major core facts at issue which are the premise of judgment by reducing the authority of the jury.
