(Life sentence Without thepossibility of Parole: 이하 LWOP)’선고를 중심으로 비교 고찰해봄으로서 향후 우리나라의 소년사법의 지향점을 제시해 보고자 한다.
Abstract
Public concern over abuse of wide judicial discretion injuvenile courts led the Supreme Court to intervene in the 1960sby requiring more formal procedure within the juvenile system. In the landmark case In re Gault, the Court rejected the doctrineof parens patriae as valid justification for the denial of dueprocess and implemented many procedural rights previouslyregarded as unnecessary for the juvenile system. The increase injuvenile crime beginning in the 1980s and the resulting panicsparked an unprecedented legislative response from almost allfifty states in the 1990s. The public abandoned its previousconcern over the abuse of discretion and arbitrary treatmentwithin juvenile courts pre-Gault, and replaced it with thesentiment that existing criminal laws for juveniles were toolenient. Incited by the public’s moral panic, legislators capitalizedon phrases such as "adult time for adult crime."On June 25, 2012, the Supreme Court held in Miller v. Alabama that mandatory life sentences without the possibility of parole for juvenile offenders violate the Eighth Amendment ofthe U.S. Constitution. This ruling is the latest of a series ofdecisions that acknowledge that three fundamental characteristicsof youth—lack of maturity, vulnerability to negative influences, and capacity for change—make children “constitutionallydifferent” from adults and “less deserving of the most severepunishments.”The LWOP violates the basic human rights of youth offendersand conflicts with the Court’s stated respect for human dignityunder the Eighth Amendment. We have a criminal justicesystem based on human rights.
