Abstract
The purpose of this study is to examine the dilemma and implications of the zero-tolerance criminal policy for juvenile offenders in the U.S. The dilemma of U.S. zero-tolerance policy for juvenile offenders is as follows. First, there is a recurring conflict between the Federal Supreme Court and state courts over zero-tolerance punishment, such as the death penalty, life imprisonment without parole, and adult court prosecution for juvenile offenders. Second, the zero-tolerance policy is criticized as a criminal treatment that does not take into account the development and individual environment of youth and as harsh retaliatory sanctions. Third, detention of juvenile offenders in adult prisons is inappropriate criminal justice treatment; fourth, the political inclination of the Federal Supreme Court has undue influence on juvenile offender rulings; fifth, the School Gun Prohibition Act, which is the basis for the zero-tolerance criminal policy for juvenile offenders, applies only to public schools, and as a result, It is criticized for causing certain races and poor groups to be treated differently. The dilemma of U.S. zero-tolerance criminal policy for juvenile offenders gives us the following implications. First, a uniform zero-tolerance policy for juvenile offenders can become a pipeline that leads juveniles to become criminals. Second, detention treatment that presupposes separation from the family cuts off the social capital of juvenile offenders, making resocialization difficult. Third, the prosecuter prior decision system toward juvenile offenders may overly expand the prosecutor’s discretion and result in human rights violations. Fourth, the introduction of a juvenile criminal court is necessary. Fifth, individual evaluation of juvenile delinquents must be properly conducted. Sixth, a strict zero-tolerance policy for juvenile offenders results in enormous social costs, and seventh, consistent rulings and judicial policies by judicial institutions are needed for the punishment of juvenile offenders.
