직장 괴롭힘의 개념과 판단기준에 관한 판례법리

최근 소위 ‘갑을관계’로 통칭되는 고용 상 발생되는 괴롭힘 관련 분쟁이 사회적 문제로 대두 되고 있으나, 법제도의 미비와 함께 그 판단에서도 일관된 법리를 형성하고 있지 못하다. 고용 상 괴롭힘과 관련한 판례의 경향을 살펴보면, 아직까지 사용자와의 권리를 고려한 나머지 괴롭 힘을 법적 규제의 대상이라거나 또는 구제의 대상으로 전적으로 인정하지는 않고 있는 것으로 보인다. 다만, 최근에는 괴롭힘에 대한 국민의 인식을 반하듯 근로자의 인격권 내지 인권 침 해로 인정되는 흐름이 엿보이고 있어, 인격권 및 인권의 관점에서 매우 고무적인 현상으로 보 인다. 이 연구에서는 직장 내 괴롭힘과 관련된 판례를 검토한다. 그 유형을 분석하고 실질적으로 판단에서 괴롭힘이 어떻게 반되고 있는지, 그 법리와 판단기준을 확인하고 분석한다.
Abstract
Recently, disputes related to harassment at the workplace -- so-called ‘ gap-eul, or relationship with the contracting party (i.e., relations where one party has the power of a master over the subordinate)’ -- are emerging as social issues. However, there is no consistent judgment on these issues, moreover a lack of legal basis. Outcomes in judicial precedents related to harassment at the workplace reveal that the rights of the employer are still emphasized. Thus, many judicial judgments may not be considered harassment, and therefore not subject to legal restrictions or legal remedy. However, recent trends show the move toward recognizing harassment from the perspective of personal (or morality) rights and human rights -- a very encouraging phenomenon. In this study I examine judicial cases related to harassment at the workplace in Korea. I identify and analyze how the harassment is actually reflected in the judgment, its jurisprudence, and judgment criteria.
