본 논문은 소년사범의 사회내처우(보호관찰을 중심으로)의 연혁등을 검토하고, 지도감독 · 원호 및 응급구호 · 사회봉사명령 · 수강명령 등 내용을 고찰하여, 문제점과 그 개선안을 제시하고자 한다. 각국의 형사정책의 방향은 목적형·교육형주의로 대표되는 특별예방이론의 영향 아래 범죄자의 격리·구금을 통한 사회방위로부터 구금을 수반하지 않는 사회내처우를 통하여 범죄자를 개선시킴으로써사회를 방위하려는 방향으로 발전해 왔고, 보호관찰은 사회내 처우의 핵심을 이루고 있다. 따라서 본 논문은 비행소년에 대한 보호관찰을 중심으로 우리에게 적합한 보호관찰제도의 정착을 위한 법적성격의 문제 · 제도 운영상의 문제 · 중간처우의 문제 · 보호관찰의인력 등 문제점과 법규의 정비 · 회복적 사법 가치의 활용 · 중간처우의 구축 · 민관협력 체제의 강화 등의 발전안을 제시하고자 한다.
Abstract
In this paper, the concept of the probation system , foreign institutions to review the history , supervision , arcs, and emergency relief , community service , probation , including taking command to examine the contents of the current problems and the improvement of the probation system the direction suggested. The direction of the country 's criminal policy mokjeokhyeong care , education , represented by the model theory of special preventive detention under the influence of the society through the criminal defense from isolation , not involving detention through community treatment , rehabilitation by improving criminal defense community been developed in the direction you want , probation will be the core of community treatment . In this paper, the system of juvenile delinquents on probation for a suitable center of our probation system for the settlement of the legal nature of the issues and institutions , the intermediate treatment of the problem of operational issues , personnel issues, the issue of probation and probation maintenance of the revised regulations the use of restorative justice , the middle value of the treatment system construction, expansion of professional staff, including the strengthening of public-private cooperation to propose the development direction.
