난하이혼다 파업과 중국 노동운동에 대한 함의

The Strike in Nanhaihonda and its Implications for China’s Labor Movement

초록

본 논문은 난하이혼다 파업에 대한 중국 언론의 기사, 난하이혼다 파업의 노사협상에 참여한 인사, 난하이혼다 파업에 대한 학술 논문을 기초로 난하이혼다 파업을 재구성하고, 난하이혼다 파업의 특징, 난하이혼다 파업의 중국 노동운동에대해 가진 함의를 분석한다. 난하이혼다 파업은 중국에서 파업의 정당성을 입증했을 뿐 아니라 중국의 농민공이 ‘권익 보호형’ 노동운동에서 ‘이익 추구형’ 노동운동으로 전환하고 있다는 것을 보여준다. 그런 의미에서 중국 노동운동의 패러다임이 전환되고 있다. 본 논문은 난하이혼다 파업에서 나타난 몇 가지 특징을 다음과같이 요약하고 있다. 첫째, 노사 갈등에 대한 정부의 중립적 역할이다. 둘째, 노사협상의 ‘당사자주의’와 확연히 구분되는 ‘이해당사자의 협상’ 방식이다. 이해당사자의 협상 방식은 중국의 노동쟁의 해결 시스템의 불완전성을 보여주는 것이기도하지만, 다른 한편으로는 다양한 중재자들이 노사 당사자들의 협상을 촉진하고,노사협상의 파국을 막는 기능을 했다는 점에서 ‘중국식 노사협상 방식’의 새로운가능성도 보여주고 있다. 셋째, 노동쟁의 과정에서 외자기업의 자본 측의 행위를제약하는 이데올로기, 즉 사회주의 및 민족주의 이데올로기가 작동하여 노사 갈등이 극단화되지 않는다. 넷째, 중국 노동자의 자발적 노동운동의 조직적 성과는중국 총공회가 독점하고 있다. 본 논문은 이 같은 특징 때문에 ‘세계의 공장’이된 중국이지만, 특별한 계기가 없는 한 중국에서는 ‘조직적, 전투적 노동운동’이나타나기 힘들다고 주장한다.

Abstract

This paper recomposes the full story of the strike in Nanhaihonda that broke out from 27 May 2010 to 4 June 2010 on the basis of news articles,some scholars’ articles about the strike of Nanhaihonda, interview materials. This paper analyses the characteristics of the strike in Nanhaihonda, and derives some implications for China’s labor movement from the analysis. The strike in Nanhaihonda not only verifies the legitimacy of strike in China, but also indicates that the Chinese peasant workers’ labor movement is transferring from ‘the rights-protecting labor movement’ to ‘the interests-seeking labor movement’. This paper summarizes the characteristics of the strike in Nanhaihonda: the neutrality of government agents in the process of strike; the appearance of stakeholders’ participating in the labor disputes which is very different from the voluntarism of the labor disputes; the restrained foreign capital’s behavior due to the ideology of socialism and nationalism; the occupation of organizing outcomes of the spontaneous Chinese peasant workers’ unrest by the upper level trade union. This paper points that stakeholders’ participating in the labor disputes reveals the incompleteness of Chinese labor dispute mediation mechanism on the one hand, but also presents the possibility of ‘collective bargaining with Chinese characteristics’. This paper argues that although labor movements are arising in China which already has become ‘the factory of the world‘,but it is not likely to arise independent and militant labor movement in China without some particular variables.
