개혁개방 이후 중국 노동정책의 변화:‘친자본’에서 ‘형식적 노동보호’로

이 글의 요지는 첫째, 개혁개방 이후 중국의 노동 부문에서 진행되었던 변화의 과정은 ‘친자본’ 또는 ‘신자유주의’적 정책이 관철되어 왔던 과정이었으며, 둘째, 그 과정에서 수많은 노동문제가 누적되어 중국 사회의 안정을 해칠 수 있는 심각한 사회문제로 전환되고 있으며, 셋째, 노동문제의 심각성을 자각한 중국공산당이 최근 내놓고 있는 다양한 노동보호 정책은 ‘제한적’ 또는 ‘형식적 노동보호’ 정책에 그치고 있다는 점이다. 개혁개방 이후 중국공산당이 채택했던 친자본적 노동정책은 노동력 상품화의 과정에서 압축적으로 나타나기 때문에 이 글은 중국 노동력의 상품화 과정에 주목하고 있다. 중국의 친자본적 노동 환경은 노동력의 상품화 과정과 동시에 조성된다. 따라서 이 글은 중국의 노동력 상품화 과정을 묘사하면서, 중국의 노동력 상품화 과정에서 나타나고 있는 특이한 점, 즉 과거 사회주의 계획경제 체제하에서 국가의 보호가 취약했던 농촌 노동력과 국가의 보호가 강했던 도시 노동력의 상품화 과정은 각각 다르게 나타나고 있다는 점에 주목한다. 즉, 전자는 신자유주의 자본 축적 방식의 요구에 맞도록 신속하게 재편되고 있으나 후자의 경우는 그렇지 않은 현상에 주목한다. 도시와 농촌 노동력의 상품화 과정이 각각 다르게 나타나고 있는 것은 국가의 노동정책과 사회주의적 유산의 영향이 도시 노동력과 농촌 노동력에 각각 다르게 작용하고 있기 때문이다. 이 글이 분석 대상으로 삼고 있는 노동문제의 쟁점 사항은 단기적 고용관행으로 인한 고용관계의 불안정성, 노동자의 합법적인 권리 침해, 국유기업 노동자 해고에 따른 경제적 보상금 문제, 노동자의 참여가 보장되는 국유기업 지배구조 확립 문제와 이와 연관된 노동자의 재산권 보장 문제, 나날이 증가되고 있는 노동쟁의 문제 등이다. 이 글은 이 같은 쟁점 사항들을 분석한 뒤 최근 노동계약법, 노동쟁의 조정 중재법 등 일련의 법제를 통해 등장하고 있는 중국공산당의 노동보호 정책의 성격을 노동관계의 시각에서 규명해보고, 향후 중국 노동관계의 발전 전망을 제시하고 있다.
Abstract
This article argues the regime of thirty years of reform and opening-up in China is the process of penetration of pro-capital policy into China. There are two the reasons for this argument. First, CCP’s labor policy is the evidence which CCP’s adopts neo-liberalism. Labor commercialization and the formation of low-priced labor forces, easy exploiting labor class, powerless trade union are the characteristics of neo-liberalism. The developmental strategy based on the induction of FDI and export-driven policy have made Chinese labor market more business-friendly. Second, the external neo-liberal force constraints CCP’s room to maneuver labor policy. The time CCP adopted reform and opening-up policy coincides with the time America and England reorganized their economy throughout the measures of neo-liberalism. If CCP does not alter the economic developmental strategy, Chinese economy will be more deeply incorporated into the world economy, and CCP’s room to maneuver labor policy will be more narrowed. This article analyses four issues, China’s FDI policy and it’s implications for the Chinese labor; the commercialization of Chinese labor forces; labor problems, for examples, the characteristics of Chinese labor markets and powerless trade union and the increase of spontaneous labor dispute; the prospect of China labor relation. Generally labor relation is regulated by labor contracting parties, this article argues the importance of trade union. Because Chinese trade union faces the structural dilemma posed by Leninist transmission belt, it fails to protect labor rights. So there are lots of spontaneous collective resistance in China, and labor’s spontaneous collective resistance becomes serious social problem. For obtaining of workers’ support, ACFTU drew up a document entitled “Basic thoughts on trade union reform” in the 1988. However due to the turbulent events of 1989 and the accusation of ACFTU involvement in the protests, this document was not implemented. Up to now, CCP and ACFTU have no reform program surpasses this document. Although CCP putted out some laws of labor protection recently, but it did not reform the model of classic dualism, so some of laws of labor protection seem like ‘limitted-labor protection laws’. This article argues, unless CCP does not change pro-capital labor policy it will face the demand of reform from bottom-up.
